The following members were present: ayor ilde, cilmen Seibold and paeth The ol1 owing members were absent: Councilmen Hunt anNeils.— Mayor ei s. isMa or Hilde introduced the following P.asolution and moved adoption: Iona op ton: RESOLUTION NO. 77-288 APPROVING CONDITIONAL USE PERMIT TO EXCEED HEIGHT LIMITATIONS IN R-1 ZONING DISTRICT FOR COB BURANDT AT 14510 -13TH AVENUE N. WHEREAS, on March 21, 1977 this Council did deny a Conditional Use Permit to exceed height limitations in the R-1 zoning district for Mr. Rolf Erickson whose property located at 14520 - 12th Avenue North was to have been used for the purposes of testing and evaluating a wind generator desigend and constructed by Mr. Cob Burandt, and WHEREAS, Mr. Cob Burandt is now requesting permission to erect a wind generator of similar design and size to be located at his own residence, 14510 - 13th Avenue North, and HHEREAS, the purpose of said wind generator is to demonstrate the feasibility and/or potential for generating electricity for household purposes, which demonstration project is being supported in part by the Minnesota Energy Agency, and WHEREAS, the concerns previously expressed by this Council with respect to a 60 foot high wind generator in a residential location are substantially mitigated by the fact that the wind generator will be located on Mr. Burandt's property and subject to his direct personal supervision; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that: 1. The City does hereby grant to Mr. Cob Burandt a Conditional Use Permit to exceed the height limitations in an R-1 zoning district for a 60 foot high wind generator to be located on his property at 14510 -13th Avenue N. 2. Such Conditional Use Permit is granted subject to the following conditions: a. In the event it is demonstrated that said wind generator does in fact interfere with the use of electrical appliances, radio or television signals or should the wind generator cease to be operative, become unsafe or electric generation unfeasible, then in such event petitioner does agree to remove said structure from his premises, and in the event that he is unwilling to do so that the City of Plymouth may enter upon the premises of petitioner and remove said wind generator. The grant of the Conditional Use Permit is made in consideration of the experimental nature of the project and in view of the funding received by petitioner from the Minnesota Energy Agency and the grant of such permit is further conditioned upon the continued experimental nature of the project. c. That the Conditional Use Permit be reviewed after two years. 3. The petitioner shall enter into an agreement, in a form agreeable to petitioner, providing the petitioner will agree to reimburse the City for the costs of removing the wind generator tower if the City is required to remove such tower. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Spaeth, and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde and Councilman Spaeth. Councilman Seibold voted nay. ' Whereupon the Resolution was declared duly passed and adopted.
