FOR CONDITIONAL USE PERMIT TO OPERATE A USED CAR SALES OPERATION IN A B-3 ZONING DISTRICT (A-404) WHEREAS, Lee Allen Auto, inc. has requested a conditional use permit to operate a used car sales operation ii a B-3 Zoning District to be located at the northwest corner of West Medicine Lake Drive and Highway 55; AND, WHEREAS, the Planning Comn•ission has reviewed said request and recommends its denial; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the request of Lee Allen Auto, Inc. for a conditional use permit for operation of a used car sales operation in a B-3 Zoning District based on the following findings: Per Section 20, Subdivision 2, paragraph 1, Conditional Use Permits, said operation and "the establishment, maintenance and conducting of the use for which a use permit is sought will . be detrimental . . . to persons residing in the area adjacent to the use, (and) to the public welfare . . . (and) injurious to the property in the area adjacent to such use." Further, that the location of the proposed sign would violate the 20 ft. setback provision of the Zoning Ordinance. The motion for the adoption of the foregoing Resolution was duly seconded by councilman Neils , and upon vote being taken thereon, the following voavor thereof: __Actina Mayor Hunt, Councilmen Neils SCi$Qld and Spaeth ine following Voted against or s None Whereupon the Resolution was declared duly uass t .
