Seibold and Spaeth following me ers were sent: _ Mayor Hilde •�a :*a Councilman Seibold introduced the following Resolution and moved is tion: RESOLUTION #77-218 APPROVING AMENDED PRELIMINARY PLAT AND CONDITIONAL USE PERMIT FOR SUBDIVISION UNIT PROJECT FOR S.J.GROVES FOR "WELLINGTON ADDITION" (A-472) WHEREAS, S. J. Groves has requested approval of an amended preliminary plat and a conditional use permit for a Subdivision Unit Project for the "Wellington Addition" located North of 36th Avenue North and West of Union Terrace Lane, consisting of 42 single family detached dwelling units; AND, WHEREAS, the Planning Commission has reviewed said plat and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of S: J. Groves for an amended preliminary plat and a conditional use permit for a Subdivision Unit Project for the "Wellington Addition" located North of 36th Avenue North and West of Union Terrace Lane, consisting of 42 single family detached dwelling units subject to the following conditions: 1. Normal Subdivision Unit Project setbacks shall be maintained except that no structure shall be placed within 50 ft. of 36th Avenue North. 2. The rear lot width of Lot 4, Block 3 and Lot 8, Block 4 shall be increased to 30 ft. 3. Subdivision Unit Project Open Space and Public Open Space requirements shall be the area labelled "park" (to be re -labelled "Outlot A") and payment of fees - in -lieu or in kind improvements of $12,600 ($300 per lot). 4. Development contract provisions for, construction by the developer of an 8 ft. asphalt trail within Outlot A and a 5 ft. concrete sidewalk from Outlot A southerly along the east side of Wellington Lane to 36th Avenue North. 5. Development contract provisions prohibiting private access to 36th Avenue North. 6. Lot 17, Block 3 to have private access to 36th Place North only. Resolution 077-218 Page 2 7. Compliance with provisions of City Engineer's memorandum on this project. FURTHER, that a variance from the provisions of Section 7, Subdivision 7, Paragraph 2e of the toning Ordinance be approved to allow payment of fees -in -lieu for 1.84± acres of the Subdivision Unit Project Open Space deficit.
