R ESOLUTION A PPROVING A SSIGNMENT OF C ONSTRUCTION C ONTRACTS TO RJM
C ONSTRUCTION FOR THE P LYMOUTH C REEK C ENTER
R ENOVATION AND E XPANSION P ROJECT
WHEREAS, City and Contractor (RJM) have entered into that certain Standard Form of
Agreement between Owner and Construction Manager dated the June 9, 2020 (“Contract”), whereby
Contractor undertakes the construction management of project known as the Plymouth Creek Center
Renovation and Expansion (“Project”); and
WHEREAS, at its June 23, 2020 meeting the City Council authorized advertisement of bids and
quotes. The project was advertised from June 24 through July 28, 2020, and bids were publicly opened
on July 28, 2020; and
WHEREAS, the Project bid documents included the proposed contract for the Work (as defined
in the Contract); and
WHEREAS, the Contract requires that the City assign to RJM all of City’s rights in and to contracts
for the construction of the Work (as defined in the Contract) which have been competitively bid and
awarded by the City.
NOW, THEREFORE, in consideration of the mutual promise and agreements made in the
Contract and other good and valuable consideration the receipt and sufficiency of which is hereby
acknowledged:
1. City hereby grants, transfers and assigns to RJM all of its right, title and interest in and to the
contracts identified below as included in the bid documents.
2. The RJM hereby consents to and accepts this Assignment and agrees to perform all of its
obligations under the Contract for the benefit of the City. RJM will enter into the contracts
in the same form included in the bid Documents with the contractors awarded the bids,
quotes and alternates by the City.
3. This Assignment shall be binding upon and inure to the benefit of the City and RJM and their
respective heirs, successors and assigns, as the case may be.
4. This Assignment may be signed in more than one counterpart, together which shall
constitute an original document.

WHEREAS, there were 10 alternates for the project as determined by the project team (architect,
RJM and staff). The project team recommends seven alternates at a cost of $317,377:
Alt 1 – install DEFS in lieu of EIFS ($68,600 value)
Alt 2 – elevator modernization ($140,873 value)
Alt 3 – existing storefront & entrance framing ($0 value)
Alt 4 – lower level window replacement ($9,796 value)
Alt 6 – front sidewalk ($32,384 value)
Alt 7 – existing door replacement ($66,724 value)
Alt 9 – security software licensing (-$1,000 value)
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the assignment of construction contracts for bids, quotes and seven alternates to RJM
Construction for the Plymouth Creek Center Renovation and Expansion Project in the amount of
$41,242,448 is approved.
APPROVED by the City Council on this 25th day of August, 2020.
