Councilman Spaeth introduced the following Resolution and moved
its adoption:
RESOLUTION #77475
AMENDING RESOLUTION #77-142 TO CHANGE CONDITION #4 OF CONDITIONS TO BE MET PRIOR TO
FILING LOT DIVISION OF PLATTED KOPERTY FOR BERNARD TOUHEY (A-721)
WHEREAS, the City Council, by Resolution #77-141, approved the lot division of Bernard
Touhey's property located south of County Road 15 and west of Zachary Lane;
AND, WHEREAS, the City Council, by Resolution #77-142 set conditions to be met prior
to filing of said lot division with Hennepin County;
AND, WHEREAS, petitioner has requested relief from condition #4 of said resolution
#77-142 which states "A single curb -cut access only to Zachary Lane by combined
driveways at property line with on-site turn -around provisions" wherein petitioner
requests that both lots be allowed to access Zachary Lane by private driveways for
the purpose of saving trees;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does amend condition #4 of Resolution #77-142
to read as follows: "On-site driveway turn -around provisions shall be incorporated
on both lots."
The motion for the adoption of the foregoing Resolution was duly seconded
byells , and upon vote being taken thereon, the
folliwuig voted in tavor thereof: Councilmen Hunt, Neils and Spaeth
me roiiowsng voted against or abstain : None
Whereupon the Resolution was declared duly—passed and adopted.
