R ESOLUTION A PPROVING AN E NCROACHMENT A GREEMENT FOR R ETAINING W ALL ON
P ROPERTY LOCATED AT 6035 Y ELLOWSTONE L ANE N ORTH
WHEREAS, Nikolas L. Borschofsky and Jessica A. Broschofsky, property owners, have requested
the City of Plymouth to approve an encroachment agreement allowing construction of a boulder wall
within drainage and utility easements at 6035 Yellowstone Lane North; and
WHEREAS, the owner’s properties are legally described as:
Lot 25, Block 1, Westin Ridge Addition.
WHEREAS, the encroachment agreement permits only the boulder wall within the easements
and all related facilities must still meet all applicable City codes; and
WHEREAS, as stated in the encroachment agreement, if the City requests that the structure
needs to be removed in the future, it will be at the property owners’ expense.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the encroachment agreement allowing the retaining wall within drainage and utility
easements at 6035 Yellowstone Lane North is approved.
