HomeMy WebLinkAboutCity Council Resolution 2020-231 C ITY OF P LYMOUTH R ESOLUTION N O. 2020-231 R ESOLUTION A PPROVING AN E NCROACHMENT A GREEMENT FOR R ETAINING W ALLS AND RD S PLIT R AIL F ENCES IN THE G REENWAY N ORTH 3 A DDITION (2020046) WHEREAS, Pulte Homes of Minnesota LLC, property owner, has requested the City of Plymouth to approve an encroachment agreement allowing construction of retaining walls and split rail fences within drainage and utility easements in the Greenway North 3rdAddition development; and WHEREAS, the owner’s properties are legally described as: Outlot A and Lots 3, 4, 5, 9 and 10, Block 7, Lots 1, 2 Block 8 and Lot 6, Block 5 Greenway North 3rd Addition. WHEREAS, the encroachment agreement permits only the retaining walls and split rail fences within the easements and all related facilities must still meet all applicable City codes; and WHEREAS, as stated in the encroachment agreement, if the City requests that the structure needs to be removed in the future, it will be at the property owners’ expense. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the encroachment agreement allowing the retaining walls and split rail fences within the drainage and utility easements in the Greenway North 3rd Addition is approved.
