The following members were present:— The following rs weffwismeonkt:'nt Councilman Seibol Councilman Spaeth introduced the following Resolution and moved its tion: RESOLUTION NO. 77-171 RECEIVING REPORT AND CALLING HEARING FOR PROJECT NO. 706 49th AVENUE WHEREAS, pursuant to resolution of the Council adopted February 28, 1977 a report has been prepared by McCombs -Knutson Associates, Inc. with reference to the improvement of 49th Avenue east from Larch Lane by the construction of 9 ton bituminous streets with concrete curb and gutter, sanitary sewer, water main, storm sewer and all necessary appurtenances and this report was received by the Council on March 21, 1977. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. The Council will consider the improvement of 49th Avenue from Zachary Lane to the east line of the Schmidt Lake Woods plat approximately 1300 feet west of the west line of Zachary Lane in accordance with the report and the assessment of abutting property for all or a portion of the cost of the improvement pursuant to Minnesota State Statutes 429.011 to 429.111 (Laws 1953, Chapter 398, as amended) at an estimated cost of the improvement of $573,000.00. 2. A public hearing on such proposed improvement for that portion of 49th Avenue from approximately 2600 feet east of Larch Lane to Zachary Lane shall be held on the 2nd day of May, 1977 in the Council Chambers of the City Public Works Building, 14900 23rd Avenue North, at 7:30 p.m. and the Clerk shall give mailed and published notice of such hearing and improvement as required by law. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Neils and upon vote being taken thereon, the following voteg in favor thereof: Councilmen Neils, Hunt and Spaeth The owing voted against or abstained: None Whereupon the Resolution was declared duly passed wid adopted.
