The folloa:ing members were present:Mayor d ounci]men Hunt Neils and Soa�:fli The following members were sent: C o u n c i I man ei clu RRR RRR RRR Councilman Spaeth introduced the following Resolution and moved its a tion: RESOLUTION #77- 169 APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR PRODUCTIVITY, INC. (A-692) WHEREAS, Productivity, Inc. has requested approval of a site plan and conditional use permit for a 10,300 sq. ft. structure to be located in the switheast quadrant of Niagara Lane and 28th Avenue North for office/warehouse/assemoly uses; AND, WHEREAS, the Planning Commission has reviewed said request and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Productivity, Inc. for site plan and conditional use permit for a 10,300 sq. ft. structure to be located in the southeast quadrant of Niagara Lane and 28th Avenue North for office/warehouse/ assembly uses subject to the following conditions: 1. Compliance with City Engineer's memorandum regarding this project. 2. All equipment, waste and waste storage containers shall be stored within the structure only. 3. Compliance with fire protection recommendations. 4. All site areas disturbed during construction shall be seeded and/or sodded. 5. Payment of Park Dedication fees -in -lieu of $605 prior to building permit issuance. 6. Provision of an 18 month performance security for.all site improvements and landscaping to be provided to the City prior to building permit issuance. FURTHER, a variance be granted for side yard setback of the south property line to allow a common driveway with property to the south. Setback allowed will be 0 ft. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Neils , and upon vote being taken thereon, the following voted in favor ereof: Councilmen Hunt, Neils and Spaeth -rne following voted against or abstained: None Wlereupon the Resolution was declared duly passed and adopted.
