Neils and Sa eth The following members were absent: unc"i0an Sei-bold RRR RRR RRR Councilman Spaeth introduced the following Resolution and moved its adoption: RESOLUTION #77-137 APPROVING PRELIMINARY PLAT AND CONDITIONAL USE PERMIT FOR SUBDIVISION UNIT PROJECT FOR WESTMINISTER ADDITION (A-717) WHEREAS, Philip Feldman has requested approval of a preliminary plat and a conditional use permit for a Subdivision Unit Project for Westminister located west of West Medicine Lake Drive at 30th Avenue North and consisting of 57 lots; AND, WHEREAS, the Planning Commission has reviewed said requests and recommends their approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does approve the requests of Philip Feldman for preliminary plat and a conditional use permit for a Subdivision Unit Project for Westminister located west of West Medicine Lake Drive at 30th Avenue North and consist- ing of 57 lots subject to the following conditions: 1. Redraft of Lots 1-7, Block 2 and 30th Avenue North to preclude all fill activity within the floodway per Exhibit 19 of the DHUD Floodway Boundary Map dated September, 1976. There shall be no variances for gross lot area inasmuch as the extension of Pineview Lane will dispense with one lot and, with lot rearrangements, all lots would meet the 18,500 sq. ft. lot area requirements of the Zoning Ordinance. 2. All fill activity proposed in the floodplain (existing elevation 930 ft. or below) but outside of the floodway shall be compensated for on a cubic foot for cubic foot basis below elevation 926 ft. by pond excavation in proposed Outlot B. Lot lines of lots abutting the resulting pond shall extend into the excavated pond area so as to preclude dry land area within the outlot. Pond construction shall be to City Engineer's specifications. 3. Outlot A and the resulting Outlot B area shall be storm water holding areas with Outlot A to be dedicated to the City and the area of Outlot B to be incorporated in abutting lots but subject to drainage easements to the city. 4. Petitioner shall receive 7.0 acres credit toward SUP Open Space and Public Open Space requirements for 7.65 acres of Storm Water drainage or equal volume pending replacement reserved or dedicated (reflecting a portion of this plat to represent EV 5% of the 235 acre tributary area of BC P-39). Based on current design, no additional fees -in -lieu shall be required. Resolution N77-137 10 Page 2 10 5. Proposed "Pineview Circle" shall be extended southerly through proposed Lot 15, Block 2, to the south border of the plat. 6. Rear lot width of Lot 33, Block 1 shall be increased to 33 ft. 1. Compliance with provisions of Bassett's Creek -Watershed District and the State of Minnesota with respect to dredge/fill activities. 8. Complaince with the provisions of the City Engineer's memorandum regarding this project. 9. Vacation of Town Road on the northerly plat border. 10. No access to West Medicine Lake Drive or Xenium Lane for lots abutting thereto. 11. Completion of the Engironmental Assessment Review process prior to final plat submission to the 04ty.
