A RESOLUTION ESTABLISHING AND MANDATING THE
INFORMATION REQUIRED TO BE FURNISHED BY
APPLICANTS FOR 'OFF -SALE" AND "ON -SALE'
INTOXICATING LIQUOR LICENSES AND PROVIDING
THE FORMS TO BE USED THEREFOR AS PROVIDED BY
CHAPTER III, SECTION 4.05 OF THE CITY CODE
WHEREAS, Chapter III, Section 4.05 of the City Code
provides as follows:
"Every person desiring a license for either "on" or
"off"sales shall file the application in the form
to be prescribed by the State Liquor Control
Commissioner and with such additional information
as the City Council may require."
and,
WHEREAS, in order that the City may have information with
respect to such applicants which is sufficient to provide a
basis for making an informal decision ,.A the question of the
acceptance or rejection of an application and,
WHEREAS, the City Manager, Chief of Police and other members
of the City administrative staff believe that applicants should
furnish the City with information concerning their application
in addition to that prescribed by the State Liquor Control
Commission in order that a thorough and comprehensive
investigation of such applicants may be made and,
WHEREAS, it is the recommendation of the City Manager and
Chief of Police that the forms attached hereto and made a part
hereof as though fully set forth at this point should be adopted
by the City of Plymouth as the official application forms of the
City for the use of applicants seeking "off -sale" or "on -sale"
intoxicating liquor licenses,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH AS FOLLOWS:
1. The forms attached hereto, which are made a part
hereof as though fully set forth at this point, are
hereby designated as the forms to be used by applicants
seeking "off -sale" or "on -sale" intoxicating liquor
licenses within the City of Plymouth.
2. The information sought to be elicited by such
forms is deemed to be such additional information
required by the City Council from an applicant for an
"off -sale" or 'on -sale' intoxicating liquor license
as provided in Chapter Ili. Section 4.05 of the City
Code.
3. The City Manager is directed to cause such forms
to be prepared and the City Clerk is directed to provide
each applicant for an 'off -sale' or 'on -sale" intoxicating
liquor license with such forms and require that they be
completed and furnished to her prior to the commencement
of any investigative procedure by officials of the City.
