Seibold and Spaeth The following members were a sent: one *** *** *** Councilman Hunt introduced the following Resolution and moved its tion: RESOLUTION #77-9 APPROVING RPUD CONDITIONAL USE PERMIT AND PRELIMINARY PLAT FOR ENTERPRISE PROPERTIES (A-681) WHEREAS. Enterprise °rnperties, has requested approval of a preliminary plat and RPUD con-litional use permit °or a preliminary plan dated November, 1976 for "Schmidt Lake Woods" located in the north half of Section 11; AND, WHEREAS,,.r; Planning Commission has reviewed said request and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Enterprise Properties for a preliminar; plat and RPUD conditional use permit for preliminary plat dated November, 1976, for "Schmidt Lake Woods" located in the north half of Section 11, subject to the following conditions: Lot line adjustments to increase the lot areas of the following lots to a minimum of 14,500 sq. ft.: a. Lot 15, Block 2 b. Lots 17, 18 and 19, Block 5 c. Lots 2, 3, 4, 5, 6, 8, and 23, Block 6 d. Lot 1, Block 7 2. No private curb cut access to 49th Avenue North be permitted. 3. Compliance with provisions of City Engineer's memorandum regarding this project. 4. Lots abutting the railroad tracks be 18,500 sq. ft. with a minimum lot frontage at setback of 85 ft. The trail corridor shall be used in calculating the effective lot sizes. 5. A settling pond be established at the northeast corner of the plat by developer. 6. Provisions shall be included in the development contract to insure minimum silta- tion from surface run-off during construction. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Neils , and upon vote being taken thereon, the folf wiwang whin a—-Treof: _Mayor Hilde. Councilmen Hunt.
