Pursuant to due call and notice thereof, a Requlir meeting of the City
Council of the City of Plymouth, Minnesota,wasexon the 3rd day of
Jauan ry , 19 77. The following members were present:

Councilman Hunt introduced the following Resolution and moved
its adoption:
RESOLUTION #77-7
AUTHORIZING THE VACATION OF DRAINAGE AND UTILITY EASEMENTS FOR
LOTS 2 AND 3, BLOCK 2, CIRCLE STAR BUSINESS CENTER SECOND ADDITION
WHEREAS, a petition to vacate drainage and utility easements located on Lots 2
and 3, Block 2, Circle Star Business Center Second Addition has been received by
the City Council from the property owners adjacent to Lots 2 and 3, Block 2,
Circle Star Business Center Second Addition; and
WHEREAS, a public hearing with respect to said vacation was held on January 3, 1977,
in accordance with Minnesota Statutes. 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of January 3, 1977; and
WHEREAS, the Council did hold a public hearing on January 3, 1977 to inform any and
all interested parties relevant to the vacation of drainage and utility easements
for Lots 2 and 3, Block 2, Circle Star Business Center Second Addition; and
WHEREAS, it was determined by the City Council that the utility easements were not
needed for Lots 2 and 3, Block 2, Circle Star Business Center Second Addition;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
as follows:
1) That an easement for drainage and utility purposes over the west 10 feet
of Lot 3, Block 2, Circle Star Business Center Second Addition, except
the south 15 feet thereof, be vacated; and
That an easement for drainage and utility purposes over the east 10 feet
of Lot 2, Block 2, Circle Star Business Center Second Addition, except
the south 15 feet thereof, be vacated;
SAID LOTS BEING LOCATED IN SECTION 21, TOWNSHIP 118, RANGE 22; and

2) That said vacation shall not affect the authority of any person,
corporation or municipality owning or controlling electric or telephone
poles and lines, gas and sewer lines, or water pipes, mains and hydrants
thereon or thereunder, to continue maintaining the same or to enter upon
such way or portion thereof vacated to repair, replace, remove or
otherwise dttend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded
by Counci�lmaap Ne is , and upon vote being taken thereon, the
