Pursuant to due call and notice thereof, a �s�ecial meeting of the City
Council of the City of Plymouth, Minnesota, was h6ld on t e 13th day of
December , 19 76 . The following members were present:

Councilman Neils introduced the following Resolution and moved

RESOLUTION NO. 76-728
APPROVING REQUEST FOR PAYMENT NO. 5 8 FINAL
1976 STREET IMPROVEMENT PROJECT
WHEREAS, the City of Plymouth, as Owner and Hardrives,Inc. as contractor, have
entered into an agreement for the improvement of:
1) Project 415: 21st Avenue from Lancaster Lane to Kilmer Lane and Kilmer Lane from
st Avenue to 19th Avenue by the installation of street restoration.
2) Project 417: 24th Avenue North and T.H. 101 in the Imperial Hills 6th Addition
y t e installation of 7 ton bituminous streets with concrete curb and gutter:
3) Pro ect No. 502: Comstock Lane, 30th Avenue, 29th Avenue and Black Oaks Lane all
within the Mapledell First Addition by the construction of 7 ton bituminous street
without concrete curb and gutter.
4) Project No. 505: 7 ton bituminous street with concrete curb and gutter on 45th
venue from Larch Lane easterly and northerly to the terminus in the cul-de-sac
in the plat of Shorewood Acres Addition.
5) Project No. 514: The streets in the Greentree West Addition including the following:
WtF venue between Brockton Lane and Xanthus Lane; 27th Avenue between Brockton Lane
and Zircon Lane; Alvarado Lane between 30th Avenue and Brockton Lane; Xanthus Lane
between Zircon Lane and County Road 24; Zircon Lane south of 27th Avenue to the south
line of the Greentree West Addition and the following cul-de-sacs: Alvarado Lane
north to 30th Avenue; A4lvarado Lane south to 27th Avenue; 26th Avenue west of Zircon
Lane; 27th Avenue southeast of Xanthus Lane; 28th Avenue southeast of Xanthus Lane;
also Brockton Lane between County Road 24 and approximately 1400 -feet south of
County Road 24, a portion lying outside of the plat by the installation oFstreets
including concrete curb and gutter.
6) Project No. 521: Olive Lane between County Road 6 and 19th Avenue North by the
nsta at on oT bituminous streets with concrete curb and gutter.
7) Project No. 603: Nathan Lane between 45th and 49th Avenue by the construction of
rural section --bituminous streets,
said Agreement being dated May 7, 1976, and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final Request for Payment,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:

1. That the original contract amount was $303,502.50 and that Change Orders No. 1-4
in the amount of $50,617.67 were approved making a revised contract amount of
$ 354,120.17 and that +he value of the work completed to date is $301,263.18.
2. That the work performed by the contractor for the 1976 Street Improvement Project
and certified to the Council by the Engineer as acceptable ba and the same hereby
is accepted as of December 13, 1976. The Contractor is hereby released from the
contract except as to the conditions of the Performance Bona any and all legal
rights of the owner, required guarantees and Correction of Fau'.ty Work after Final
Payment.
3. Request for Payment No. 5 and Final in the amount of $44,963.39 to Hardrives, Inc.
for the 1976 Street Improvement Project is hereby approved and the City Finance
Director is hereby authorized and directed the pay the same forthwith.

The motion for the adoption of the foregoing Resolution was duly seconded
by Councilman Spaeth, and upon vote being taken thereon, the following voted
10in avor t ereof: Mayor Hilde, Councilmen Hunt, Neils, Seibold and Spaeth
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
