HomeMy WebLinkAboutCity Council Resolution 2020-214 C ITY OF P LYMOUTH R ESOLUTION N O. 2020-214 R ESOLUTION A PPROVING A F INAL P LAT AND D EVELOPMENT C ONTRACT FOR RD “G REENWAY N ORTH 3 A DDITION” (2020046) WHEREAS, Pulte Homes of Minnesota has requested approval of a final plat for the roughly 13.443-acre parcel presently legally described as: Outlot D, Greenway North and Outlot B, C and D, Greenway West, Hennepin County, Minnesota WHEREAS, city staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Pulte Homes of Minnesota for a final plat rd for “Greenway North 3 Addition”; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. A final plat is approved to allow the property to be subdivided into 18 lots for townhomes and 30 lots for single-family, in accordance with the application and plans received by the City on June 11, 2020, June 18, 2020. July 10, 2020 and July 14, 2020, except as may be amended by this resolution. 2. Prior to release of the final plat for recording, the applicant shall: 1) receive City approval of final construction and storm water plans; 2) receive approval of the Troy Lane right-of-way vacation; 3) execute a development contract and submit related fees and financial guarantees; and 4) pay the park dedication cash fee in lieu of land dedication for 48 new dwelling units, in accordance with the dedication ordinance in effect at the time of filing for the final plat. 3. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Submit HOA documents or covenants that include the following: 1. Assigning maintenance of common improvements including wetland buffer, wetland buffer monuments, sidewalks, retaining walls, mailboxes, subdivision signs, split rail fences, and other common elements. 2. Disclosure that roads stubbed to the north, west, and south will eventually get extended when development is proposed. b. Pay for or agree to be assessed for sewer and water area charges and watermain lateral special assessment. c. Revise the plans as follows: 1. Block 4, Lots 1 and 2 shall be oriented to face Urbandale Lane. d. Revise the plans to meet fire code requirements as follows: 1. Provide fire flow calculations. The required fire flow calculations shall comply with the minimum required for the square footage and construction type of the largest structure. 2. Approved turnarounds are required at dead ends exceeding 150 feet. 3. Fire lane signs are required in approved locations on fire turnarounds. 4. The hammerhead turnaround on Urbandale Court must be dimensioned per the City requirements. 5. All attached townhouses must be protected with a City approved fire sprinkler system. e. Submit an executed encroachment agreement for retaining walls and split rail fence as shown on the Easement Encroachment Agreement Exhibit dated 7/20/2020. f. Revise the plans to meet engineering requirements as follows: 1. All stormwater BMPs shall meet City requirements for location, size and functionality. 2. All retaining walls that are necessary for the creation of usable lots and which cross property lines shall be shown on the plans and be HOA maintained. 4. Encroachment agreements will be required for retaining walls in a drainage and utility easement. 5. Encroachment agreements will be required for monument signs proposed in drainage and utility easements. 6. No retaining walls or signage is permitted in trail easements. 7. No new driveway access to County Road 47 or Troy Lane shall be permitted. 8. Obtain all required Hennepin County right-of-way construction permits. 9. Obtain Elm Creek Watershed approval. 10. Obtain MDH, MPCA & MCES permits. 11. Provide sod between townhome driveways instead of rock. 12. Provide sod, irrigation and landscaping within the City-owned parcel west of Troy Lane. 13. Construction of County Road 47 turn lanes must be completed by September 31, 2020. 14. Prior to the issuance of a building permit, the applicant shall submit a survey indicating: a. Silt fence and tree preservation fencing installed consistent with city code. b. For lots abutting the wetland or pond, the lowest floor elevation shall be at least two feet higher than the high water elevation for the wetland or pond. 15. Standard Conditions: a. No building permits shall be issued until proof of recording is submitted for the final plat, easements, and other recordable documents and the streets (including curb and gutter installation) needed for access to lots where permits are requested are paved with the first lift of asphalt, and the sewer and water service utilities are installed and approved by the city engineer/designee. b. If the required sidewalks are not installed when the streets are installed, no building permits shall be issued for lots abutting the future sidewalk unless a separate sidewalk agreement is provided for each affected lot. c. Development standards and setbacks for the townhome portion of the plat shall comply with the RMF-2 zoning standards. No variances are granted or implied. d. Development standards and setbacks for the single family portion of the plat shall comply with the RSF-3 zoning standards. No variances are granted or implied. e. All retaining walls over four feet shall require issuance of a building permit and a three- foot fence installed on top of the wall. f. All retaining walls over four feet on the property or all walls regardless of height within a drainage and utility easement must be shown on the building permit survey. g. Driveways shall be set back a minimum of 40 feet from intersections as measured from the intersection of property lines. h. Compliance with the City’s tree preservation regulations. i. No trees shall be planted in the public right-of-way. j. Signs shall require a separate permit and comply with section 21155 of the zoning ordinance. k. Removal of all hazardous trees from the property at the owner's expense. l. This approval shall expire two years after the date of approval, unless the applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 512 of City Code.
