HomeMy WebLinkAboutCity Council Resolution 2020-201 C ITY OF P LYMOUTH R ESOLUTION N O. 2020-201 R ESOLUTION A PPROVING AN E NCROACHMENT A GREEMENT FOR A R ETAINING W ALL ON P ROPERTY LOCATED AT 5405 U NION T ERRACE L ANE N ORTH WHEREAS, David and Lindsey Hudson, property owners of 5405 Union Terrace Lane North and Trustees of the Hudson Living Trust, have requested the City of Plymouth to approve an encroachment agreement for a retaining wall within drainage easements at 5405 Union Terrace Lane North; and WHEREAS, the owner’s properties are legally described as: Lot 001, Block 002, The Ponds at Bass Creek 2nd Edition Addition. WHEREAS, the encroachment agreement permits only the retaining wall within the easements and all related facilities must still meet all applicable City codes; and WHEREAS, as stated in the encroachment agreement, if the City requests that the structure needs to be removed in the future, it will be at the property owners’ expense. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, approves the encroachment agreement allowing a retaining wall within drainage easements at 5405 Union Terrace Lane North is approved. APPROVED by the City Council on this 28th day of July, 2020.
