Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota, was held on the 15th day of
November , 19_16_. The following members were present:

Councilman Seibold introduced the following Resolution and moved

RESOLUTION NO. 76- 686
AUTHORIZING CONDEMNATION PROCEEDINGS
CHANNEL EXCAVATION WORK
PROJECT NO. 116 PINETREE POND
WHEREAS, the City of Plymouth has undertaken Project No. 116, Pinetree Pond Storm
Sewer Improvements which include construction of certain storm sewer pipe, ditches,
and other improvements, and
WHEREAS, in order to construct the improvements certain easements are required,
and
WHEREAS, the City Council finds it to be necessary, proper and expedient in the
interest of public health, convenience and general welfare of the citizens of the
City of Plymouth for the City to acquire certain construction and disposal area
easements,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the City Attorney is hereby authorized to commence condemnation pry
for Project No. 116, Pinetree Pond Storm Sewer Improvements, for the parcels of -
property described in attached exhibit.
The motion for the adoption of the foregoing resolution was duly seconded by
Councilman Neils and upon vote being taken thereon, the following
voted infavor thereof: Councilmen Hunt, Neils, Seibold and Spaeth
The following voted against or abstained: Mayor Hilde not present for vote.
Whereupon the Resolution was declared duly passed and adopted.

The West 988.4 feet of the South 45 rods of the Northwest Quarter of

That part of the above parcel lying Easterly and Southerly of the following
described line, to -wit: Commencing at the Southeast corner of said parcel;
thence Westerly along the South line of said parcel for a distance of 115
feet; thence deflecting to the right 900 00' for a distance of 270.43 feet;

A ten foot permanent easement and a forty foot temporary construction easement
centered on the following described line: Commencing at the Southwest corner
of Lot 7, Block 1, Fzendin-Krogness Addition; thence Westerly along the North
line of the Southeast Quarter of Sectio 31 for a distance of 15.0 feet, thence
deflecting to the left 900 00' for a distance of 30.00 feet to the actual point
of beginning; thence deflecting to the right 300 38' for a distance of 62.75
feet; thence deflecting to the right 80 44' a distance of 135 feet; thence
deflecting to the right 320 40' to the shore line of Hadley Lake and there
terminating.
