The following members were present: Mayor H11de, Councilmen HunT—.Neils, Seibold and Spaeth The following members were sent: None RRA RRR RRR Mayor Hilde introduced the following Resolution and moved its adoption: RESOLUTION NO. 76-669 AUTHORIZING MAYOR AND CITY MANAGER TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF PLYMOUTH AND SHENANDOAH HOMEOWNERS ASSOC. GIVING CITY RIGHT TO ENTER PRIVATE STREETS IN SHENANDOAH FIRST AND SECOND ADDITIONS TO MAKE REPAIRS ON SEWER AND WATER LINES WHEREAS, certain subdivisions of land known and platted as Shenandoah First and Second Additions have been developed within the City, and WHEREAS, as part of such development sanitary sewer lines and water mains have been installed beneath the surface of the streets in such subdivisions, and WHEREAS, although such sewer lines and water mains are public utilities of the City with respect to which the City has a continuing obligation for maintenance, the streets themselves are private streets not owned, controlled or maintained by the City, and WHEREAS, such private streets together with other areas in said subdivisions are owned in common by the individual property owners therein by and through the Homeowners Association, and WHEREAS, it is necessary that the City have a right of entry over, under and across such private streets for the purpose of providing maintenance services with respect to such sewer lines and water mains; , NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the Mayor and City Manager be and the same are hereby authorized and directed to enter into the agreement by and between the City of Plymouth and Shenandoah Homeowners Association giving the City the right of entry over, under and across the private streets of the Shenandoah First and Second Additions for the purpose of providing maintenance services with respect to sewer lines and water mains. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Neils , and upon vote being taken thereon, the following voted in favorthereof: Mayor Hilde, Councilmen Hunt, Neils, Q9 d end Spaeth Inc =viiowing voted against or abstained: Hhereupon the Resolution was declared duly RAR ARA RRA
