rPursuant to due call and notice thereof, a r lar meeting of the City
Council of the City of Plymouth, Minnesota, was ie on t e --A$ ��da y of

Ma or Hunt, Councilmen Seibold and Spaeth
The following members were absent:—Mayor Hilde and Councilman Neils
Councilman Seibold introduced the following Resolution and moved
s adoption:
RESOLUTION #76- 603
AUTHORIZING VACATION OF DRAINAGE AND UTILITY EASEMENTS WITHIN PLYMOUTH
FREEWAY CENTER (A-377)
WHEREAS, a petition to vacate certain drainage and utility easements within Ply-
mouth Freeway Center has been received by the City Council from the property owners;
AND, WHEREAS, a public hearing with respect to said vacations was held on October 18,
1976 in accordance with Minnesota Statutes, Section 412.851;
AND, WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of October 18, 1976;
AND, WHEREAS, the Council did hold a public hearing on October 18, 1976 to inform any
and all interested parties relevant to the vacation of said drainage and utility
easements within Plymouth Freeway Center;
AND, WHEREAS, it was determined by the City Council that said drainage and utility
easements are not necessary within Plymouth Freeway Center;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. That that part of Tracts'A and B, Registered Land Survey No. 1424 files of the
the Registrar of Titles. County of Hennepin, embraced in the following described
property: A strip of land 10 feet in width, the center line of which is
described as beginning at a point on the line dividing Lots 2 and 3, Block 1,
Plymouth Freeway Center according to the plat thereof on file and of record in
the office of the Registrar of Titles, Hennepin County, Minnesota distant 30
feet Northeasterly of the Southwesterly or most Westerly corner of said Lot 3;
as measured along the line dividing said Lots 2 and 3; thence North 20 degrees,
14 minutes, 59 seconds East along the line dividing said Lots 2 and 3 a distance
of 285.00 feet; thence South 69 degrees, 45 minutes, 01 -z?conds East along the
line dividing said Lots 2 and 3 a distance of 130.00 feet; thence North 20
degrees, 14 minutes, 59 seconds East along the line dividing said Lots 2 and 3
a distance of 68.01 feet to the Southwesterly right-of-way of Empire Lane according

to said Plymouth Freeway Center and there terminating. It is intended that said
10 foot wide strip of land extends by its full width to the Southwesterly right-
of-way line of said Empire Lane. All to be vacated as utility and drainage
easements.
That said vacation shall not affect the authority of any person. corporation or
municipality owning or controlling electric or telephone poles and lines, gas
and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to
continue maintainina the same or to enter upon such wady or portion thereof
vacated to repair, replace, remove or otherwise attend thereto.
The m,,tion for the adorLion of the foregoing Resulution was duly seconded
