HomeMy WebLinkAboutCity Council Resolution 1976-5590 • CITY OF PLYMOUTH Pursuant to due call and notice thereof, a spegial meeting of the City Council of the City of Plymouth, Minnesota, was heid on the 27th day of lr%pptamhar_ , 19_jb, The following members were present: The o owing members were a sent: None Councilman Spaeth introduced the following Resolution and moved Its adoption: - RESOLUTION NO. 76- 569 ADOPTING ASSESSMENT 1976 STREET LIGHTING WHEREAS, pursuant to proper notice duly given as required by iaw, the City Council has met and heard and passed upon all objections to the proposed assessment for the cost of operating and maintaining street lighting to certain areas of the City of Plymouth, NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof; is hereby accepted and -shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of one year, the first of the installments to be payable on or before the first Monday in January, 1977 and shall bear interest at the rate of 8% per annum from the date of adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1976. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Finance Director pay the whole of the assessment on such property, with interest accrued to the date of payment to the City Finance Director, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may. at any time thereafter, pay to the County Finance Director the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Finance Director to be extended -on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5. The total cost of the improvement assessed by this resolution is $ 15,581.40. Resolution No. Page 2 The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Seibold , and upon vote being taken thereon, the following voted in favor thereof: Maror Hilde, Councilmen Hunt. Neild Seihnld and Spaeth. The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adoptee. CITY OF PLYMOUTH Pursuant to due call and notice thereof, a s ectal meeting of the City Council of the City of Plymouth, Minnesota, was held on the 27th day of Se tember , 19 76 The following members werepresent: maH e, ouncilme� n Aunt, Neils, Seibold and Spaeth Ine following members were absent: None Councilman Seibold introduced the following Resolution and moved s adoption: RESOLUTION NO. 76-559 ADOPTING'ASSESSMENT PROJECT NO. 415 21ST AND KILMER LANE WHEREAS, pursuant to proper notice duly given as required by taw, the Council has met and heard and passed upon all objections to the proposed -assessment for the improvement of 21st Avenue from Lancaster Lane to Kilmer Lane and Kilmer Lane from 21st Avenue to 19th Avenue by the installation of water main, street restoration and f, all necessary appurtenances, and for previously installed trunk water main facilities, NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Finance Director, pay the whole of the assessment on such property with interest accrued to the date of payment to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter pay to the County Finance Director the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Finance Director to be extended on the proper tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5. -The total cost of the improvement assessed by this resolution is $17,426.64 The total cost of City participation is $8,005.36 and is to be financed from the utility trunk fund. Resolution No. 76_559 Page 2 The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Neils , and upon vote being taken thereon, the following voted in favor thereof: Mayo The following voted agains or abstaine None 'aeth. Whereupon the Resolution was declared duly passed and adopted.
