CITY OF PLYMOUTH
Pursuant to due call and notice thereof, a special meeting of the City
Council of the City of Plymouth, Minnesota, was held on the 27th day of
September , 1976 . The following members were present:`'

Councilman Hunt introduced the following Resolution and moved

ADOPTING ASSESSMENT !
PROJECT NO. 502 MAPLEDELL ADDITION
PROJECT NO. 517 MAPLE CREEK ADDITION
UNPLATTED
WHEREAS, pursuant to proper notice duly given as required by law, the Council has met
and heard and passed upon all objections to the proposed assessment for the improvement
of the extension of a portion of the South District Sanitary Sewer Interceptor from the
intersection of 27th Avenue and Dunkirk Lane then easterly approximately 1400 feet, then
northerly 1700 feet to point 51A (Mapledell Trunk) as shown on the Report of the Comprehen=''
sive Sewer Plan for Plymouth, Minnesota dated 1972 and on Comstock Lane, 29th Avenue, Black
Oaks Lane, 30th Avenue and.31st Avenue all within the Mapledell First Addition by the
construction of sanitary sewer, water main, drainage structures and 7 ton bituminous streetk
and all necessary appurtenances including previously constructed trunk water facilities and;;;,;
the improvements to the proposed Maple Creek Addition (legally described as the East 99 rod's'
of the North 80 rods of the Southeast Quarter of Section 20, Township 118, Range 22) by the
installation of sanitary sewer, water main, drainage structures and street grading and all
necessary appurtenances including previously constructed water trunk facilities,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is
hereby accepted and shall constitute the special assessment against the lands named
therein, and each tract of land therein included is hereby found to be benefited by the
proposed improvement in -the amount of the assessment levied against it.
Such assessment shall be payable in equal annual installments extenning over a period
of ten years, the first of the installments to be payable on or before the first Monday
in January, 1977 and shall bear interest at the rate of 8% per annum from the date of
adoption of this assessment resolution. To the first installment shall be added interest
on the entire assessment from the date of this resolution until December 31, 1976. To
each subsequent installlment when due shall be added interest for one year on all unpaid':
installments.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the County Finance Director, pay the whole of the assessment on such
propepty with interest accrued to the date of payment, to the City Treasurer, except
that no interest shall be charged if the entire assessment is paid within 30 days from
the adoption of this resolution; and he may, at any time thereafter, pay to the County
Finance Director, the entire amount of the assessment remaining unpaid with interest
accrued to December 31 of the year in which such payment is made.

4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the
County Finance Director to be extended on the proper tax lists of the County, and
such assessments shall be collected and paid over in the same manner as other municipal'
taxes.
5. The total cost of the improvement assessed by this resolution is $139,819.15.
The total City cost for sewer and water main trunk facilities is $179,008.39 which
is to be financed from the utility trunk fund.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilman Neils , and upon vote being taken thereon, the following
voted in favor thereof: Mayor Hilde, Councilm
