Pursuant to due call and notice thereof, a special meeting of
the City Council of the City of Plymouth, Minnesota was held on the the
13th day of September , 1976 . The following members were
present: Mayor Rlde, Councilmen Neils Seibold and Spaeth
The following members were absent: Councilman Hunt
Councilman Seibold introduced the following Resolution and moved
its adoption:
RESOLUTION #76-509
AUTHORIZING VACATION OF A PORTION OF EAST MEDICINE LAKE BOULEVARD
WHEREAS, a petition to vacate East Medicine Lake Blvd.from County Road 9 to the
north boundary of Mission Ridge Addition has been received by the City Council from
the property owners adjacent to East Medicine Lake Blvd. between County Road 9 and
the north boundary of Mission Ridge Addition;
AND, WHEREAS, a public hearing with respect to said vacation was held on Spetember 13,
1976 in accordance with Minnesota Statutes, 412.851, as amended;
AND, WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of September 13, 1976;
AND, WHEREAS, the Council did hold a public hearing on September 13, 1976 to inform
any and all interested parties relevant to the vacation of East Medicine Lake Blvd.
between County Road 9 and the north boundary of Mission Ridge Addition;
AND, WHEREAS, it was determined by the City Council that with the completion of Zachary
Lane between 36th Avenue North and County Road 9, a certain portion of East Medicine
Lake Blvd is not needed between County Road 9 and the north boundary of Mission Ridge
Addition for a public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. That that part of East Medicine Lake Blvd._ all lying south of the right-of-way
line of County Road 9 all in Section 14, Township 118, Range 22, be vacated
as public roadway.
2. That said vacation shall not affect the authority of any person, corporation or
municipality owning or controlling elec'i•ric or telephone poles and lines, gas
and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to
continue maintaining the same or to enter upon such way or portion thereof
vacated to repair, replace, remove or otherwise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilman Spaeth , and upon vote being taken thereon, the
foll-owing voted in favor thereof: Mayor Hilde. Councilmen Seihold and
