The following members were present: ng members were absent: Councilman Seibold Councilman Neils introduced the following Resolution and moved its adoption: RESOLUTION X176- 497 DENYING CONDITIONAL USE PERMIT FOR GAS PUMPING OPERATION FOR JAMES REFRIGERATION (A-678) WHEREAS, James Refrigeration Co. has requested a conditional use permit to operate a gas pumping service at the southwest corner of Highway 101 and Merrimac Lane; AND, WHEREAS, the Plymouth Planning Commission has reviewed said request and recom- mends its denial; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH MINNESOTA that it should and hereby does deny the request of James Refrigeration Co. for a conditional use permit to operate a gas pumping service at the southwest corner of Highway 101 and Merrimac Lane based on the following findings: I. The use proposed is not compatible with the Land Use Guide Plan. 2. The use proposed would create traffic loads that Merrimac Lane was not intended to handle. 3. The use proposed would constitute a safety hazard due to the residential neigh- borhood adjacent to the site.
