CITY OF PLYMOUTH
Pursuant to due call and notice thereof, a special meeting of the City
Council of the City of Plymouth, Minnesota, was held on the 23rd day
of August 19 76 . The following members were present:
e• Councilmen Hunt, Neils and Spaeth
ng members were absent: Eouncilman Seibold
Councilman Neils introduced the following Resolution and
moved its adoption:
RESOLUTION #76- 496
DENYING CONDITIONAL USE PERMIT FOR PDQ GROCERY STORE FOR JAMES REFRIGERATION CO. (A-678)
WHEREAS, James Refrigeration Co. has requested a conditional use permit to operate
a PDQ grocery store at the southwest corner of Highway 101 and Merrimac Lane;
AND, WHEREAS, the Planning Commission has reviewed.said request and has made its
recommendation;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that it should and hereby does deny the request of James Refrigeration to
operate a PDQ grocery store at the southwest corner of Highway 101 and Merrimac Lane
based on the following findings:
1. The use proposed is not compatible with the Land Use Guide Plan.
2. The use proposed would create traffic loads that Merrimac Lane was not intended
to handle.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilman Hunt , and upon vote being taken thereon, the

Whereupon the Resolution was declared duly passed and adopted.
