The following members were present:ayNi or Hilde, Councilmen Hunt, Neils and Spaeth The following members were absent: rnunrilman Seibald Councilman Spaeth introduced the following Resolution and moved its adoption: RESOLUTION #76-494 DENYING SITE PLAN APPROVAL REQUEST OF JAMES REFRIGERATION FOR CONVENIENCE SHOPPING CENTER (A-678) WHEREAS, James Refrigeration Co. has requested site plan approval of a neighborhood convenience center to be located at the southwest corner of Highway 101 and Merrimac Lane; AND, WHEREAS, the Plymouth Planning Commission has reviewed said request and has made recommendations; N0W, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does deny the request of James Refrigeration for site plan approval for a neighborhood convenience center at -the southwest corner of Highway 101 and Merrimac Lane for the following reasons: Front or rear yard does not meet 50 ft. setback requirement and Council would not waiver setback variance across from a residential zone. 2. Excessive driveways create traffic hazards. 3. Although the zoning is B-3, it is adjacent to a residential area on the west and the hours that the establishments would keep and traffic they would generate would be a violation of those residents' rights to a residential type of existence, The motion for the adoption of the foregoing Resolution was duly seconded by _ Councilman Neils , and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilda. Councilmen Hunt, NPilsand Spaeth The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
