The following members were present: Ma or Hilde Councilmen Hunt, Neils and Spaeth TE e o lowing members were absent: Councilman Seibold +++ +t+ tits► Councilman Spaeth introduced the following Resolution and moved is a opt on: RESOLUTION 4. 76- 470 ADOPTING ASSESSMENT PROJECT NO. 518 PLYMOUTH FREEWAY CENTER ADDITION WHEREAS, Harris Brothers, Inc., as developers, have petitioned for the improvement of the Plymouth Freeway Center Addition (legally described as that part of the NW4 of the SW 4, Section 22, Township 118, Range 22,lbrnepin County, Minnesota lying northerly of State Trunk Highway No. 55 and westerly of interstate Highway No. 494 and westerly of The east line of the west 48.88 rods thereof) by the construction of sanitary sewer, water main, 9 ton bituminous streets with concrete curb snd gutter, storm drainage facilities and all necessary appurtenances, and WHEREAS, the Developer of the Plymouth Freeway Center Addition has submitted a waiver of . assessment hearing for this project, NOW THEREFORE, CE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto, and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefitted by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of ten years, the first of the installments to be payable on or before the first Monday in January 1977, and shall bear interest at the rate of 8% per annum from the date of adoption of this assessment resolution. To the first installment shall be added interest on the entire assbssment from the date of this resolution until December, 1976. To each subsequent installment when due shall be added 'nterest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Finance Director pay the whole of the assessment on such property with interest accrued to the date of payment, to the City Finance Director except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may at any time thereafter, pay to the County Finance Director the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the . County Finance Director to be extended on the proper tax lists .,f the County and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5, The total cost of the improvement is $116,729.00, includinr water area charges. The total construction cost of the project is $107,699.00. The amount previously paid by the developer is $25,303.50. The cost of the improvement assessed by this resolution is $91,425.50 including $9,030.00 of water area charges.
