HomeMy WebLinkAboutCity Council Resolution 1976-467W W CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota, was held on the 23rd day of August , 1976 . The following members were present: Havo�y�e�Councilmen Hstnt, Neils and Spaeth The following mem ers were a sent: Councilman Seibold Councilman Hunt introduced the following Resolution and moved is adoption: - RESOLUTION NO. 76-467 ADOPTING ASSESSMENT PROJECT NO. 503 NATHAN LANE STREET IMPROVEMENT WHEREAS, pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessment for the improve- ment of Nathan Lane between County Road 9 and 49th Avenue by the construction of 9 ton bituminous street, concrete curb and gutter with related storm sewer construction between County Road 9 and 45th Avenue and revisions to the Frontage Road at County Road 9; and gravel base construction between 45th Avenue and 49th Avenue, NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNC;L OF THE CITY OF PLYMOUTH, MINNESOT 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall r:nstitute the special assessment against the lands. named therein and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extendinq over a period of ten years, the first of the installments to be payable on or aefore the first ,onday in January, 1977 and shall bear interest at the rate of 8% per annum -from the date of the adoption of thi: assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1976. To each subsequent installment when due shell be added interest for one year on all unpaid <qstallments. The owner of any property so assessed may, a., any time prior to certification of the assessment to the County Finance Director, pay the whole of the assessment on such property, with interest accrued to the date of payment to the City Finance Director, except that no interest shall be charged if the entire assess,nent is paid within 30 days from the adoption of this resolution; a.d he may, at any time thereafter, pay to the County Finance Director the entire amount of the a-s4ssment remaining unpaid with interest accrued to December 31 of the year in wh-,cn such payment is made. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Finance Director to be extended on the proper tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5. The total cost of the improvement assessed by this resolution is $ 255,004.07. The total cost of the improvement is $255,004.07. Resolution No. 76-467 Page 2 The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Neils, and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Hunt, Neils and Spaeth. The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
