HomeMy WebLinkAboutCity Council Resolution 1976-418CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 2nd day of August 1976 . The following members were present: MavorI,lde. Coun�ilrr�n Hunt.11eils._�eibold and Spaeth The following mernhers were a sent: Nonce Councilman Seibold introduced the following Resolution and moved its adoption: RESOLUTION #76- 418 DENYING CONCEPT PLAN FOR RPUD 76-2 "PIGTAIL ALLEY" FOR ROGER FAZENDIN AND DON HUSTAD (A-522) WHEREAS, Roger Fazendin and Don Hustad have requested Concept Plan approval of pro- posed RPUD 76-2, loceted at the southeast side of Hadley Lake and known as "Pigtail Alley", and have requested a waiver of the 40 -acre minimim requirement for the RPUD Ordinance; AND, WHEREAS, the Plymouth Planning Commission has reviewed said request and made recommendations; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does 4,ny the concept plan of "Pigtail Alley" as proposed by Roger Fazendin and Don Hustao, located at the southeast side of Hadley Lake based on the finding that the project as proposed does not warrant a waiver of the 40 -acre minimum requirement as it is nut deemed to be in the "public interest" nor does it meet either of the following conditions as per Section 20, Subdivision 'a—,para- graph 3 (a) (1): Unusual features of the property itself or of the surrounding neighborhood are such that development under the standard provisions of the normal District would not be appropriate in order to conserve a feature of importance to the neighbor- hood or community. The property adjoins property that has been developed under the provisions of said section and will contribute to the amenities of the neighborhood. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Spaeth and upon vote being taken thereon, the following voted in favor thereof: Councilmen Hunt, Seibold and Spaeth The following voted against 1D:C J% l63tAA : Mayor Hilde and Councilman Neils Whereupon the Resolution was declared duly passed and adopted.
