Pursuant to due call and notice thereof, a �regu g meeting of the City
Council of the City of Plymouth, Minnesota, was het o3 n the 26th day of

Councilman Hunt introduced the following Resolution and moved
s adoption: -
RESOLUTION NO. 76- 412
APPROVING REQUEST FOR PAYMENT NO. 8 & FINAL
PROJECT NO. 505 SCHMIDT LAKE AREA
WHEREAS, the City of Plymouth, as Owner, and Northdale Construction Company, Inc., as
Contractor, entered into an Agreement to construct 1) a portion of the North Central
Sanitary Sewer Interceptor between the following points: 15A to 15, 15 to 16, 16 to 16C,
16C to 16A, (from a point on 36th Avenue North approximately 600 feet west of Zachary
Lane; thence in a northwesterly direction to the approximate intersection of Larch Lane
and County Road 9; thence northerly along Larch Lane to 45th Avenue) as shown on the
report of the Comprehensive Sewer Plan for Plymouth, Minnesota, 1972 and subsequent

supplement on the Comprehensive Sewer Plan for Plymouth, Minnesota, 1973,
Alternate 8; 2) Water main on Larch Lane from County Road 9 to 45th Avenue; 3) Sanitary
sewer lateral, water main lateral on 45th Avenue from Larch Lane easterly and northerly
to the terminus in the cul-de-sac in the plat of Shorewood Acres Addition, said
Agreement being dated May 16, 1975, and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
Final Request for Payment,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNES
1. That the original contract amount was $466.353.20 and that Change Orders No. 1 and 2
were approved in the amount of $48,769.50 making a revised contract amount of
$515,122.70 and that the final contract amount is $487,629.61.
2. That the work performed by the contractor for Project No. 505 and certified to the
Council by the Engineer as acceptable be and the same hereby is accepted as of
July 26, 1976. The Contractor is hereby released from the contract except as to the
conditions of the Performance Bond, any and all legal rights of the Owner required
guarantees and Correction of Faulty Work after Final Payment.
3. Request for Payment No. 8 and Final in the amount of $ 32,498.62 to
Northdale Construction Company, Inc. for Project No..505, Schmidt Lake Area is
hereby approved and the City Treasurer is hereby authorized and directed to pay
the same forthwith.
10 The motion for the adoption of the foregoing Resolution was duly seconded by
Councilman Neils, and upon vote being taken thereon, the following voted in
favor Mayor Hilde, Councilmen Hunt, Neils. Seibold and Spaeth.
