HomeMy WebLinkAboutCity Council Resolution 1976-410CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 26th day of July 1976 The following members were present: t Nils Seibold and Spaeth e o ow ng members were a sent: None titer ,kir* ir>Hr Councilman Hunt introduced the following Resolution and moved— its adoption: RESOLUTION N76- 410 APPROVING REQUEST FOR PAYMENT NO. 3 AND FINAL FOR IMPERIAL HILLS NEIGHBORHOOD PARK WHEREAS, the City of Plymouth, as Owner, and Arteka, Inc., as Contractor, entered into an Agreement to construct Imperial Hills Neighborhood Park, said Agreement being dated November 26, 1975; AND, WHEREAS, the Architect and Director of Planning and Community Development have certified their acceptance of the work and their approval of the Final Request for Payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. That the original contract amount was $23,362.04 and that Change Orders No. 1, 2 and 3 were approved resulting in a net deduction of $626.10 making a revised contract amount of $22,735.94 and that the final contract amount is $22,735.94; 2. That the work performed by the contract for Imperial Hills Neighborhood Park and certified to the Council by the Planner as acceptable be and the same hereby is accepted as of July 26, 1976. The Contract is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the Owner required guarantees and Correction of Faulty Work after Final Payment. 3. Request for Payment No. 3 and Final in the amount of $5.971.60 to Arteka. Inc. for Imperial Hills Neighborhood Park is hereby approved and the City Treasurer is hereby authorized and directed to pay the same forthwith.
