HomeMy WebLinkAboutCity Council Resolution 1976-327CITY OF PLYMOUTH Pursuant to due call and notice thereof, ameeting of the City Council oJhe City 19 761ymouth, Minnesota. was a on the 21st day of une The following members were present: Mayor Hil e, Councilmen eils, Seibold and Spaeth iter t,rt �t Councilman Spaeth introduced the following Resolution and moved Its adoption: - RESOLUTION N0. 76-327 AUTHORIZING CONDEMNATION PROCEEDINGS PROJECT NO. 607 BASS LAKE AREA WHEREAS, the City has undertaken Project No. 607, Bass Lake Improvements, which include sanitary sewer, water main and street improvements, and WHEREAS, in order to construct the improvements certain easements are required, and WHEREAS, the City Council finds it to be necessary, proper and expedient in the interest of the public health, convenience and general welfare of the citizens of the City of Plymouth, for the City to acquire permanent easements NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: that the City Attorney is hereby authorized to commence condemnation proceedings for Project No. 607 for the following described parcels of property: LARCH HEIGHTS LAGOON 2ND ADDITION - OUTLOT A A perpetual easement for public utility purposes over, under and across Outlot A, Larch Heights Lagoon 2nd Addition according to the recorded plat thereof. LARCH HEIGHTS LAGOON 2ND ADDITION - OUTLOT E A perpetual easement for public utility purposes over, under and across Outlot E, Larch Heights Lagoon 2nd Addition, according to the recorded plat thereof. ' LOT 2, BLOCK 1, LARCH HEIGHTS LAGOON 2ND ADDITION 1) A perpetual easement 10 feet in width for sanitary sewer purposes over, under and across Lot 2, Block 1, Larch Heights Lagoon 2nd Addition, according to the recorded plat thereof. Said easement lying adjacent to and Northeasterly of the lot line common to Lots 2 and 3 Block 1, said Larch Heights Lagoon 2nd Addition. 2) A 40 foot temporary construction easement oyer, under and across Lot 2, Block 1, Larch Heights Lagoon 2nd Addition. Said easement lying adjacent to and northeasterly of the lot line common to Lots 2 and 3, Block 1, said Larch Heights Lagoon 2nd Addition. LOT 3, BLOCK 1, LARCH HEIGHTS LAGOON 2ND ADDITION 1) A perpetual easement 10 feet in width for sanitary sewer purposes over, under and across Lot 3, Block 1, Larch Heights Lagoon 2nd Addition, according to the recorded plat thereof. Said easement lying adjacent to and Southwesterly of the lot line common to Lots 2 and 3, Block 1, said Larch Heights Lagoon 2nd Addition. The Southwesterly line of said easement is to be extended to terminate at the Northerly line of said Lot 3. 0 0 easement consisting of a strip of land fifty (50) feet wide parallel with and adjacent to the most northerly line of Lot 1, Block 2, Timber Shores, Seccicn 2, township 118, Range 22. LOT 2, BLOCK 2,_TI_MBER SHORES 1) A temporary construction easement consisting of a strip of land twenty-five (25) feet wide parallel with and adjacent to the most westerly line of Lot 2, Block 2, Timber Shores, Section 2, Township 118, Range 22. OUTLOT B & C VALCHOFF ADDITION A perpetual easement for public utility purposes over, under and across Outlot B and C, Vale -Hoff, according to the recorded plat thereof on file and of record in the office of the Registrar of Title in and for Hennepin County, Minnesota. GOVERNMENT LOT 4 - SECTION 2 1) A perpetual easement 20 feet in width for sanitary sewer purposes and a temporary construction easement 100 feet in width over, under and across that part of the East 186.28 feet of Government Lot 4, Section 2, Township 118, Range 22, Hennepin County, Minnesota lying South of Hennepin County State Aid Highway No. 10, Plat 8, according to the recorded plat thereof. The common centerline of said easements being described as commencing at the intersection of the East line of said Government Lot 4 with the Southerly line of said Hennepin County State Aid Highway No. 10; thence on an assumed bearing of South 00 29' 50" East along the East line of said Government Lot 4 a distance of 314.49 feet �o the actual point of beginning of the cegterline to be described; thence North 73 15' 17" West 10.33 feet; thence North 81 01' 15" West 178.86 feet more or less to the West line of said East 186.28 feet and there terminating. • 2) A perpetual easement 20 feet in width for sanitary sewer purposes and a temporary construction easement 100 feet in width over, under and across that part of Government Lot 4, Section 2, Township 118, Range 22, Hennepin County, Minnesota, lying South of Hennepin County State Aid Highway No. 10, Plat 8, according to the recorded plat thereof; West of the East 186.28 feet of said Government Lot 4; and East of Bass Lake Shorewood Hills, according to the recorded plat thereof. The common centerline of said easements being described as commencing at the intersection of the East line of said Government Lot 4 with the Southerly line of said Hennepin County State Aid Highway No. 10; thence on an assumed bearing of South 00 29' 50" East along the East line of said Government Lot 4 a distance of 314.49 feet; thence North 730 15' 17" West 10.33 feet to the actual point of beginning of the centerline to be hereinafter described; thence North 810 01' 15" West 467.68 feet more or less to a point ono the East line of Lot 1, Block 1, said Bass Lake Shorewood Hills distant 274.3 feet Southerly from the most Northerly corner of said Lot 1 and there terminating. SECTIONS 2 & 11 1) A perpetual easement 20 feet in width for sanitary sewer purposes and a temporary construction easement 100 feet in width over, under and across that part of Government Lot 7, Section 2, Township 118, Range 22, Hennepin County, Minnesota, lying West of the West line of the Northeast Quarter of the Northwest Quarter of Section 11, Township 118, Range 22, extended North to Bass Lake. The common centerline of said easements is described as beginning at a point on the South line of said Government Lot 7, distant 1217.44 feet Easterly from the Southwest corner of said Government Lot 7, said South . line has an assumed bearing of South 880 59' 13" East; thence North 190 38' 10" West 70.35 feet; thence North 820 36' 38" West 313.49 feet; thence North 260 02' 36" West 249.82 feet; thence North 540 11' 48" West 356.74 feet; thence North 640 04' 18" West 318.22 feet; thence North 510 03' 30" West 258.63 feet, more or less, to a point on the West line of said Government Lot 7, distant 819.91 feet Northerly from the Southwest corner of said Government Lot 7 and there terminating. 2) A temporary construction easement 40 feet in width over, under and across Lot 3, Block 1 Larch Heights Lagoon 2nd Addition. Said easement lying adjacent to and Southwesterly • of the lot line common to Lots 2 and 3, Block 1, said Larch Heights Lagoon 2nd Addition. The Southwesterly line of said easement is tai be extended to terminate at the Northerly line of said Lot 3. LOT 4, BLOCK 1, LARCH HEIGHTS LAGOON 1) A perpetual easement for sanitary sewer purposes over, under and across that part of Lot 4, Block 1, Larch Heights Lagoon, according to the recorded plat thereof which lies 10 feet on each side of a line described as beginning at the most Northerly corner of said Lot 4; thence on an assumed bearing of South 62 40' West along the lot line common to Lots 3 and 4, said Block 1, a distance of 223.26 feet more or less to the Southwesterly line of said Lot 4 and there terminating. 2) A temporary construction easement over, under and across that part of Lot 4, Block 1, Larch Heights Lagoon which lies 30 feet on each side of a line described as beginning at the most Northerly corner of said Lot 4; thence on an assumed bearing of South 620 40' West along the lot line common to Lot 3 and 4, said Block 1, a distance of 223.26 feet more or less to the Southwesterly line of said Lot 4 and there terminating. LOT 3, BLOCK 1, LARCH HEIGHTS LAGOON 1) A perpetual easement for sanitary sewer purposes over, under and across the Southeasterly ten feet of Lot 3, Block 1, Larch Heightslagoon, according to the recorded plat thereof. 2) A temporary construction easement over, under and across the Southeasterly 20 feet of .Lot 3, Block 1, Larch Heights Lagoon. LOT 11, BLOCK 5, BIRCH VALLEY FIRST ADDITION 1) A permanent utility easement consisting of a strip of land ten (10) feet wide parallel with and adjacent to the most easterly line of Lot 11, Block 5, Birch Valley 1st Addition, Section 11, Township 118, Range.22. 2) A temporary construction easement consisting of a strip of land fifty (50) feet wide parallel with and adjacent to the most easterly line of Lot 11, Block 5, Birch Valley 1st Addition, Section 11, Township 118, Range 22. LOT 12, BLOCK 5, BIRCH VALLEY FIRST ADDITION 1) A permanent utility easement consisting of a strip of land ten (10) feet wide parallel with and adjacent to the most westerly line of Lot 12, Block 5, Birch Valley 1st Addition, Section 11, Township 118, Range 22. 2) A temporary construction easement consisting of a strip of land fifty (50) feet wide parallel with and adjacent to the most westerly line of Lot 12, Block 5, Birch Valley 1st Addition, Section 11, Township 118, Range 22. LOT 1, BLOCK 2, TIMBER SHORES 1) A permanent utility easement consisting of a strip of land twenty (20) feet wide parallel with and adjacent to the most easterly line and a permanent utility easement consisting . of a strip of land ten (10) feet wide parallel with and adjacent to the most northerly line of Lot 1, Block 2, Timber Shores, Section 2, Township 118, Range 22. 2) A temporary construction easement consisting of a strip of land fifty (50) feet wide parallel with and adjacent to the most easterly line and a temporary construction 0 2) A perpetual easement 20 feet in width for sanitary sewer purposes and a temporary construction easement 100 feet in width over, under and across the Northwest Quarter of the Northwest Quarter of Section 11, Township 118, Range 22, Hennepin County, Minnesota. The common centerline of said easements is described as beginning at a point on the North line of said Northwest Quarter of the Northwest Quarter distant 1217.44 feet Easterly from the Northwest corner of said Northwest Quarter of Northwest Quarter, said North line has an assumed bearing of South 880 59' 13" East; thence South 190 38' 10" East 95.30 feet; thence South 790 51' 07" East 61.90 feet, more or less, to the East line of said Northwest Quarter of Northwest Quarter and there terminating. 3) A perpetual easement 20 feet in width for sanitary sewer purposes and a temporary construction easement 100 feet in width over, under and across that part of the Northeast Quarter of the Northwest Quarter of Section 11, Township 118. Range 22, Hennepin County. Minnesota lying Southerly of the Soo Line Railroad right-of-way and also that part of the Southeast Quarter of the Northwest Quarter of said Section 11. lying East of the West 16.5 feet and Southerly of said railroad right-of-way. The common centerline of said easements is described as beginning at a point on the West line of said Southeast Quarter of Northwest Quarter distant 706.47 feet Northerly from the Southwest corner of said Southeast Quarter of Northwest Quarter, said West line has an assumed bearing of North 00 08' 54" East; thence North 580 25' 42" East 184.08 feet; thence North 350 30' 44" East 399.36 feet; thence North 530 10' 19" East 355.01 feet; thence North 50 22' 20" West 20.87 feet, more or less, to the South right-of-way line of said railroad and there terminating. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Seibold, and upon vote being taken thereon, the following voted in favor thereof: Ma or Hilde Councilmen Neils Seibold and Spaeth.
