Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth. Minnesota, was held on the 21st day
of June . 19_2&. The following members were present:

CoMnrilman Spaeth introduced the following Resolution and
moved its adoption:
RESOLUTION #76-320
APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR MINNESOTA TORO, INC. (A-674)
WHEREAS, Minnesota Toro, Inc. has requested approval of their site plan and a condi-
tional use permit for 30,000 sq. ft. office, shop and warehousing facility to be
located at the northeast corner of Niagara Lane and 21st Avenue North;
AND, WHEREAS, the Planning Commission haL reviewed said request and has recommended
its approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that it should and hereby does approve the request of Minnesota Toro, Inc.
for a site plan approval and a conditional use permit for 30,000 sq. ft. of office,
shop and warehousing facility to be located at the northeast corner of Niagara Lane
and 21st Avenue North subject to the following conditions:
1. Posting of a 150%, 18 month landscape and drainage bond prior to issuance of
building permits.
2. Petitioner pay a Park Dedication Fee equal to $500 per acre ($500 X 4 acres =
$2,000) payable to the City of Plymouth prior to building permit issuance.
3. Engineering recommendations be incorporated into the site as per the City Engineer.
4. Incorporation of an additional fire hydrant as recommended by the City Fire Chief.
5. Outside storage be restricted to designated paved area. Waste receptacles be
restricted to the interior of the building.
6. A setback variance be granted for the 8 ft. high fence from 25 ft. and 30 ft. to
a 15 ft. setback for the fence.
The motion for the adoption of the foregoing Resolution was duly seconded by
C 1 and upon vote being taken thereon, the

Whereupon the Resolution was declared duly passed and adopted.
