CITY OF PLYMOUTH
Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota, was held on the 3rd day
of Ma , 19 76 . The following members were present:
Mayor Hie, ounc7 men HunT Neils, Seibold and Spaeth
The following mem-ners viere absent: none
Councilman Hunt introduced the following Resolution and
moved its adoption: RESOLUTION•NO. 76- 245
APPROVING REQUEST FOR PAYMENT NO. 2 & FINAL
PROJECT NO. 507-002 PUMP FOR WELL NO. 4
WHEREAS, the City of Plymouth, as Owner, and Tonka Equipment Company, as Contractor,
entered into an Agreement to furnish the pump for Well No_ 4 in accordance with the
Water Distribution Report for the City of Plymouth, said Agreement being dated April 25, 197
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final Request for Payment, and
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $19,705.00,and that the final contract amount
10 is $19,705.00.
2. That the work performed by the Contractor for Project No. 507-002 and certified to this
Council by the Engineer as acceptable be and the same hereby is accepted as of
May 3, 1976. The Contractor is hereby released from the contract except as to the
conditions of the Performance Bond, any and all legal rights of the Owner, required .
guarantees, and Correction of Faulty Work after Final Payment.
3. Request for Payment No. 2 & Final in the amount of $6,471.00 to Tonka Equipment
Company for Project No. 507-002, Pump for Well No. 4 is hereby approved and the
City Finance Director is hereby authorized and directed to pay the same forthwith.
The motion for the adoption of the foregoing Pesolutien was duly seconded by
Councilman Seibold 1, and upon vote being taken thereon, the
following vote in favor thereof : Mayor Hilde, Councilmen Hunt, Neils,
Sei — and Spaet
