HomeMy WebLinkAboutCity Council Resolution 2020-189 C ITY OF P LYMOUTH R ESOLUTION N O. 2020-189 R ESOLUTION A PPROVING L UCE L INE R EGIONAL T RAIL C OOPERATIVE A GREEMENT; L UCE L INE P ROPERTY R IGHTS A GREEMENT; P ERMANENT E ASEMENT FOR P UBLIC T RAIL AND E MERGENCY A CCESS AT F ERNBROOK L ANE; P ERMANENT E ASEMENT FOR P UBLIC U TILITIES ADJACENT TO P ARKERS L AKE P ARK; P ERMANENT E ASEMENT FOR P UBLIC T RAIL ADJACENT TO P ARKERS L AKE P ARK; AND P ERMANENT E ASEMENT FOR P UBLIC U TILITIES ON O UTLOT A, C ARLSON C OMPANIES A DDITION WITH T HREE R IVERS P ARK D ISTRICT WHEREAS, the City has been in discussions with Three Rivers Park District to secure regional trail cooperative agreements and associated property rights on City property; and WHEREAS, City staff is addressing property rights where the City is on Three Rivers Park District property for trails, utilities and emergency access; and WHEREAS, this would legally formalize property rights between the City and Three Rivers Park District; and WHEREAS, the Luce Line Regional Trail Cooperative Agreement would serve as the basis for the future Medicine Lake and Bassett Creek Regional Trail Cooperative Agreements; and WHEREAS, Three Rivers Park District Board of Commissioners approved the Luce Line Regional Trail Cooperative Agreement, Luce Line Property Rights Agreement, Permanent Easement for Public Trail and Emergency Access at Fernbrook Lane, Permanent Easement for Public Utilities adjacent to Parkers Lake Park and Permanent Easement for Public Trail adjacent to Parkers Lake Park at the March 12, 2020 meeting; and WHEREAS, Three Rivers Park District Board of Commissioners approved the Permanent Easement for Public Utilities on Outlot A, Carlson Companies Addition at the June 4, 2020 meeting. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the City Council the Luce Line Regional Trail Cooperative Agreement; Luce Line Property Rights Agreement; Permanent Easement for Public Trail and Emergency Access at Fernbrook Lane; Permanent Easement for Public Utilities adjacent to Parkers Lake Park; Permanent Easement for Public Trail adjacent to Parkers Lake Park; and Permanent Easement for Public Utilities on Outlot A, Carlson Companies Addition with Three Rivers Park District are approved and the Mayor and City Manager are authorized to execute the agreements. APPROVED by the City Council on this 23rd day of June, 2020.
