RESOLUTION No. 2009-196
A RESOLUTION APPROVING AN INTERIM USE PERMIT FOR THREE RIVERS PARK DISTRICT FOR
GRADING/ EXCAVATION OPERATIONS RELATED TO INSTALLATION OF THE SEGMENT OF THE
MEDICINE LAKE REGIONAL TRAIL LYING NORTH OF COUNTY ROAD 47 (2009039)
WHEREAS, Three Rivers Park District has requested an interim use permit for property
located north of County Road 47, legally described as Outlot D, Camelot Estates and Outlot E,
Taryn Hills; and
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Three
Rivers Park District for an interim use permit for grading/excavation operations related to
installation of the segment of the Medicine Lake Regional Trail lying north of County Road 47,
subject to the following conditions:
1. This interim use permit is approved to allow placement, grading, and excavation involving
roughly 7,774 cubic yards of earthen material, in accordance with the application and plans
received by the City on July 20, 2009, except as may be amended by this resolution.
2. Prior to commencement of the project, the applicant shall obtain a grading permit from the
City.
3. Prior to issuance of the required grading permit, the applicant shall obtain the necessary
permits and approvals as follows: Minnesota Department of Natural Resources, Hennepin
County, Wetland Conservation Act, Elm Creek Watershed, and NPDES.
4. Prior to issuance of the required grading permit, the applicant shall provide information or
revise the plans as follows:
a. Provide a grading, drainage, and erosion control plan in compliance with the City's
erosion control policy.
b. Provide written confirmation from the City of Maple Grove indicating that wetland
mitigation will occur in Maple Grove for the proposed wetland fill in Plymouth.
c. Show the City of Plymouth corporate limits on Plan Sheets 2 and 11.
d. Designate a trick wash out area.
e. Include standard detail STRT-6 (pedestrian curb ramp) on Plan Sheet 5.

f. Extend arrows from the word "wetland" to the edge of the wetland limits on Plan Sheet
14.
g. Evaluate redesigning the trail alignment adjacent of County Road 47 so it would not
need to be reconstructed when County Road 47 is expanded in the future. Any cost to
relocate the trail will not be borne by the City.
h. Show the existing water main and profile on Plan Sheets 14 and 15.
i. Some areas over the water main have additional cover according to record plans. Re-lay
pipe where finished cover would be less than 6.0 feet. Insulate watermain where finished
cover would be less than 7.5 feet.
j. Keep trail at least three feet away from existing gate valve at Station 20+80.
k. Show existing watermain valve manhole on Plan Sheet 15.
1. Indicate watermain pothole locations.
m. Provide a trail terminus and advanced warning signs for trail terminus at the intersection
of County Road 47 and Fernbrook Lane.
n. Trail grades should not exceed five percent.
o. Connect the proposed regional trail to existing trail at Station 20+00.
p. Provide additional rip rap where needed due to culvert pipe slopes and flow velocities.
q. Provide information showing how the project would comply with N[_]RP standards and
non -degradation (removal of 60% of phosphorus and 85% of total suspended solids)
standards, and how it would pre -treat surface water runoff prior to discharge in
wetlands.
5. The applicant shall complete the project within six (6) months from the date of approval of
the interim use permit unless the applicant receives an extension from the City for a definite
time period, pursuant to Section 21185.08, Subd. 1 of the Zoning Ordinance.
6. The fill shall consist of earthen material and shall not consist of garbage, animal or vegetable
refi se, poisons, contaminants, chemicals, decayed material, filth, sewage or similar septic or
biologically dangerous material.
7. The hours for constriction operations shall be limited to between 7:00 AM and 7:00 PM
Mondays through Fridays, and between 8:00 AM and 6:00 PM on Saturdays.
8. Three Rivers Park District shall be responsible for all restoration/revegatation requirements.
