Pursuant to due call and notice thereof, a re ular meeting of the City

Council of the City of Plymouth, Minnesota, was eld on the 8th day
of March 19 The following members were present:

Councilman Neils introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 76432
APPROVING REQUEST FOR PAYMENT NO. 6 8 FINAL
PROJECT NO. 403 NORTHWESTERN BELL UTILITIES
WHEREAS, the City of Plymouth, as Owner, and C.S. McCrossan, Inc., as Contractor,
have entered into an Agreement to improvem Nathan Lane between 49th Avenue and 51st
Avenue; 49th Avenue between Nathan Lane and County Road 8; 51st Avenue between Nathan
Lane and County Road 18 by the installation of sani ary sewer, water main, 9 ton
bituminous streets with concrete curb and gutter, and storm sewer and all necessary
appurtenances, said Agreement being dated August 8, 1974,
WHEREAS, the Engineer has certified his acceptance of the work and his approval of
the Final Request for Payment,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $290,364.50 and that Change Orders were
approved in the amount.of $494,490.00 making a revised contract amount of $339,854.50
and that the value completed to date is $334,597.01.
2. That the work performed by the Contractor for Project 403 and certified to this
Council by the Engineer as acceptable be and the same hereby is accepted as of
March 8, 1976. The Contractor is hereby released from the contract except as
to the conditions of the Performance Bond, any and all legal rights of the Owner,
required guarantees and -Correction of Faulty Work after Final Payment.
3. Request for Payment No. 6 8 Final in the amount of $41,189.74 to C.S. McCrossan, Inc.
is hereby approved and the City Treasurer is hereby authorized and directed to
pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Acilman Seibold and upon vote being taken thereon, the

Whereupon the Resolution was declared duly passed and adopted.
