The following members were present: ng memoers were t** Councilman Neils introduced the following Resolution and moved Its adoption: RESOLUTION NO. 76-129 APPROVING REQUEST FOR PAYMENT NO. 3 & FINAL PROJECT NO. 304-001 HUGHES -JOHNSON ADDITIONS STREETS WHEREAS, the City of Plymouth, as Owner, and Bury & Carlson, Inc., as Contractor have entered into an Agreement to improve the streets in the Hughes 1st and 2nd Additions and the Roger L. Johnson Addition by the installation of bituminous streets with concrete curb and gutter and all necessary appurtenances, said Agreement being dated February 3, 1975, WHEREAS, the Engineer has certified his acceptance of the work and his approval of the Final Request for Payment, and NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $73,471.30 and that Change Order No. 1 was approved making a revised contract amount of $74,122.30 and the value completed to date is $80,786.15. 2. That the work performed by the Contractor for Project No. 503 and certified to this Council as acceptable be and the same hereby is accepted as of March 8, 1976. The Contractor is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the Owner, required guarantees and Correction of Faulty Work after Final Payment. 3. Request for Payment No. 3 and Final in the amount of $19,232.23 to Bury & Carlson, Inc. is hereby approved and the City Treasurer is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Seibold , and upon vote being taken thereon, the following vote n favor thereof:- Mayor Hilde, Councilmen Neils and Seibold The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted. m
