Pursuant.to due call and notice thereof, a special meeting of the City
Council of the City of Plymouth, Minnesota, was heel own the 17th day of

RESOLUTION NO. 76-116
AUTHORIZING AN AGREEMENT FOR THE CONVEYANCE AND DEDICATION
OF LAND FOR PUBLIC OPEN SPACE PURPOSES
WHEREAS, Plymouth Hills Company, a partnership, is acquiring certain lands within
the City of Plymouth legally described as follows:
The Easterly 330 feet of the Northeast Quarter (NE 1/4) of the
Northwest Quarter (NW 1/4) of Section 21, Township 118, Range
22 (hereinafter referred to as "Parcel 'A"')

The Northwest Quarter (NW 1/4) of the Northwest Quarter (NW 1/4)
of Section 21, Township 118, Range 22, excluding therefrom any
portion of said property taken for highway or roadway purposes
(hereinafter referred to as "Parcel 'B ")and,
WHEREAS, said partnership or its assigns, intends to develop said Parcel "B"
for private purposes and in connection therewith will be required,
pursuant to law, to make a dedication of lands to the City for public
open space purposes or pay cash to the City in lieu thereof and,
WHEREAS, it is hereby determined that it is in the best interests of the City
and the convenience and general welfare of its citizens that the
partnership convey and dedicate a reasonable amount of land -to the
City for public open space purposes in respect of such development and,
WHEREAS, the City Council has determined that a conveyance and dedication of
Parcel "A", described above, for public open space purposes would
satisfy the requirements of the City in connection with the development
by the partnership or its assigns of Parcel "B" and,
WHEREAS, the partnership is willing to enter into a present agreement with the
City in recordable form providing for the conveyance without cost to
the City, of said Parcel "A" to the City for public open space purposes
which agreement shall constitute a covenant which shall run with the
land,

. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH
AS FOLLOWS:
1. The Mayor and the City Manager are hereby authorized and
directed to enter into an Agreement with Plymouth Hills Company,
a partnership, providing for the dedication and conveyance to the
City and without cost to the City by the partnership of Parcel "A"
as described above.
2. Said Agreement shall be in the form of a covenant which shall
run with the land and shall be recorded and placed of record in the
office of the Register of Deeds of Hennepin County, Minnesota.
3. The City hereby agrees that such conveyance and dedication
of said Parcel "A" as provided in sich Agreement shall fully satisfy
the requirements of the City for the dedication of land for public
open space purposes in connection with the development of Parcel "B",
described above by the partnership or its assigns.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilman Neils, and upon vote being taken thereon, the following voted in
favor thereof: MayorHilde, Councilmen Hunt, Neils, Seibold and Spaeth.
The following voted or abstained: None.
Whereupon the Resolution was declared duly passed and adopted.
