The following members were present: were Councilman Hunt introduced the following Resolution and moved s adoption. - RESOLUTION opt on:RESOLUTION NO. 76-105 ADOPTING ASSESSMENT ROLL PLAT 43740 PARCEL 820 WHEREAS, Joseph Marciniak, owner of Plat 43740 Parcel 820, is proposed to be assessed for water area charges and water lateral charges, and WHEREAS, the property owner has submitted a waiver of assessment hearing on these proposed assessments, NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 2. Such proposed assessment, a copy of which is attached.hereto and made a part hereof. is hereby accepted and shall constitute the special assessment against the lands named therein and each tract of land therein included is hereby found to be benefitted by the proposed improvement in the amount of the assessment levied against it. Such assessment shall be payable in equal annual installments extending over a period of 20. years, the first of the installments to be payable on or before the first �. Monday in January 1977 and shall bear interest at the rate of 8% per annum from the date of adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 1976. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed, may at any time prior to certification of the assessment to the County Finance Director, pay the -whole of the assessment on such property with interest accrued to the date of payment to the City Finance Director except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may at any time thereafter, pay to the County Finance Director the entire amount of the assessment remaining unpaid with interest accrued to December 31 of the year in which such payment is made. 4. The Clerk shall forthwith transmit a certified copy of this assessment to the County Auditor to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5. The total cost of the improvement assessed by this resolution is $2,130.50. 1 1W W Resolution No. 76-105 Page 2 The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Neils, and upon vote being taken thereon, the following voted in favor thereof: Maor Hilde, Councilmen Hunt, Neils, Seibold and Spaeth. The following vote against orabstained: one. Whereupon the Resolution was declared duly passed and adopted.
