HomeMy WebLinkAboutCity Council Resolution 1976-0110 9 CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 5th day of January , 1976 . The following members were present: Mayor Hilde, CouncTiTmen Hunt, Neils, Seibold and Spaeth The following members were absent`. None - - -- Councilman Spaeth introduced the following Resolution and moved is adoption: RESOLUTION NO. 76-11 APPROVING REQUEST FOR PAYMENT NO. 5 & FINAL PROJECTS NO. 408 & 409 34TH AVENUE STREETS AND 36TH AVENUE SIDEWALK WHEREAS, the City of Plymouth, as Owner, and Buffalo Bituminous, Inc., as Contractor entered into an Agreement to construct a 7 ton bituminous street with concrete curb and gutter on 34th Avenue between Kilmer Lane and Pilgrim Lane and to construct sidewalk on 36th Avenue between County Road 18 and Pilgrim Lane, said Agreement being dated June 25, 1974, WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final Request for Payment, and NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $34,773.05 and that the final contract amount was revised to $ 34,521.65. 2. That the work performed by the Contractor for Projects 408 and 409 and certified to this Council by the Engineer as acceptable be and the same hereby is accepted as of January 5, 1976. The Contractor is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the Owner, required guarantees, and Correction of Faulty Work after Final Payment. 3. Request for Payment No. 5 & Final in the amount of $ 1,351.08 to Buffalo Bituminous, Inc, for Projects No. 408 and 409 is hereby approved and the City Treasurer is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded byand upon vote being taken thereon, the following voted in avor thereof: 'Mayor Hilde, Councilmen Hunt, Neils, ine Toiiowing voted against or abstained: None Whereupon the Resolution was declared duly passed an
