HomeMy WebLinkAboutCity Council Resolution 1976-010W CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 5th day of January 19 76 . The following members were present: Mayor i e, ounce men Huni, Neils, Seibold and Spaeth The following members were absent: None t** Mayor Hilde introduced the following Resolution and moved its adoption: RESOLUTION NO. 76-10 APPROVING REQUEST FOR PAYMENT NO. 9 & FINAL PROJECT NO. 305 VICKSBURG LANE WHEREAS, the City of Plymouth, as Owner, and Buffalo Bituminous, Inc., as Contractor, entered into an Agreement to improve Vicksburg Lane from County Road 6 to County Road 15, by the installation of grading, base bituminous surfacing, concrete curb and gutter, storm drainage facilities and all necessary appurtenances, said Agreement being dated July 18, 1974, and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the Final Request for Palment, and NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MI 1. That the original contract amount was $389,033.00 and that Change Orders in the amount of $11,193.70 were approved making a revised contract amount of $400,226.70 and that the final contract amount is revised to $391,865.24. 2. That the work performed by the Contractors for Project No. -305 and certified to this Council by the Engineer as acceptable be and the same hereby is accepted as of January 5, 1976. The Contractor is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the Owner, required guarantees, and Correction of Faulty Work after Final Payment. Request for Payment No. 9 and Final in the amount of $43,713.10 to Buffalo Bituminous, Inc. for Project No. 305 is hereby approved and the City Treasurer is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Spaeth , and upon vote being taken thereon, the following voted in favor thereof: `Mayor Hilde, Councilmen Hunt, Neils, Seibold and Spaeth The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
