Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on t e 5th day of January 19 76 . The following members were present: iMdyor Ht1de. Councilmen Spaeth. Hunt Neils and Seibold The ollowing mem ers were a sent: Councilman Hunt introduced the following Resolution and moved s adoption: RESOLUTION k76-2 APPROVING CONDITIONAL USE PERMIT FOR SUBDIVISION UNIT PROJECT AND PRELIMINARY PLAT FOR "FERNDALE NORTH" (A-615) WHEREAS, Lundgren Bros. Construction Co. has requested approval of a conditional use permit for a Subdivision Unit Project and preliminary plat for "Ferndale North" known as the Elwell Property; and, WHEREAS, the Planning Commission -has reviewed said requests and recommends . their approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the requests of Lundgren Bros. Construction Co. for approval of a conditional use permit for a Subdivision Unit Project and preliminary plat for "Ferndale North" be granted subject to the follow- ing conditions: 1. Storm drainage easements be provided to the City for all property fronting on Hadley Lake to elevation 964 ft. and on all property front- ing on Pond HL -P8 to elevation 949 ft. 2. Utility easements be provided to the City as per City Engineer's recom- mendations. 3. A rearrangement of Lots 6 and 24, Block 5 to conform to the pond shoreline. 4. An engineer's report to determine the feasibility of extension of Vagabond Lane to the east with the intention to stub it in instead of making it a circle at this time. 5. Lake bed area below normal water level be deleted from consideration either in the lot size determination or in park &1d open space require- ments. 6. If it is determined that Ferndale Road should, for any technical or safety reason, be upgraded, resolution to said technical and safety problems shall be sought prior to proceeding with the final Plat. 7. That the 8th Avenue North access to Ferndale North be moved more southerly. • Resolution #76-2 Page 2 The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Neils , and upon vote being taken thereon, the 0 ow ng voted n favor thereof: ayor Hilde.
