The following members were present: Mayor Councilmen Hunt, Neils Seibold and Spaeth he tollowing Members were absent: _ n ne ,rrtt rtir* *� Councilman Spaeth introduced the following Resolution and moved s adoption: - RESOLUTION #75-671 APPROVING CONDITIONAL USE PERMIT AND SITE PLAN FOR LITTLE PENINSULA PROJECT FOR DANIEL T. RALICKI AND ASSOCIATES (A-186) WHEREAS, Daniel T. Ralicki and Associates have requested a conditional use permit and site plan approval for the "Little Peninsula Project"; and, WHEREAS, the Planning Commission has reviewed said -request and recommends its approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does approve a conditional use permit and site plan for the "Little Peninsula Project" subject to the following conditions: 1) Changes in the site plan as per Fire Chief recommendations, i.e. the addition of five fire hydrants and fire lanes. 2) Recommendation of the City Engineer with respect to drainage and utility easements. DNR and Bassett Creek Flood Control Commission standards to be complied with as per their recommendations. 3) Petitioner to pay to the City's Park Dedication Fund $33,600 for Phase I cohstruction. (i.e. $150 X 224 units - $33,600) 4) Variances be allowed for front yard building setback and front yard parking setback due to the unique physical characteristics of the site, specifically the existence of a railroad right-of-way immediately adjoining the front yard. 5) That the site plan be forever limited to not more than one access point to Medicine Lake. Such singular access point shall contain a maximum of 25 mooring spaces for non -motorized water craft only. The mooring spaces shall be allotted between Phases I and II on a proportionate basis with those allocated to Phase II to be allocated only after construction of Phase II is assured. Phase I is therefore allowed 16 mooring spaces (i.e. 224 units equals 65% of the total development of 344 units --65% of the total mooring, 25, would be 16 for Phase I). a V Resolution #75-671 Page 2 6) [here shall be no outside storage of watercraft. 7) No boat launching by motorized vehicles shall be allowed on the site. 8) This resolution shall become null and void after December 31, 1976 if building permits have not been issued and work on the site structures has not begun. 9) Prior to issuance of building permits, petitioner must request and receive from the City Council. a subdivision variance effecting the combination of all land parcels used for density calculations. 10) All private streets within the project shall be 32 ft, in width and of 9 ton load design. 11) A plan for the mitigation of hazards to project tenants as a result of the adjacent raolroad track shall be submitted to the Director of Planning and Community Development prior to building permit issuance. 12) The private road servicing the project at its intersection with County Road 154 shall contain such turning lanes as determined appropriate by the City Engineer and the Hennepin County Highway Department. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Huntand upon vote being taken thereon, the following voted in favor thereof-"!:' Mayor Hilde, Councilmen Hunt, Neils and Ine roiiowing voteo against or abstained: Whereupon the Resolution was declared duly
