CITY OF PLYMOUTH
Pursuant to due call and notice thereof, a meeting of
the City Council of the City of Plymouth, Minnesota, was —heV on the
17th day of November 1975. The following members were
present: Acting Mayor Hunt Councilmen Neils Seibold and Spaeth

Councilman Neils introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 75-650
APPROVING REQUEST FOR PAYMENT NO. 4 AND FINAL
PROJECT NO. 401 NORTHEAST TRUNK SEWER
WHEREAS, the City of Plymouth, as Avner, and Rauenhorst Corporation, as Contractor,
entered into an Agreement to construct the portion of the Northeast Sanitary Sewer
Interceptor between points 5 to 5C, 5C to 6 and 6 to approximately 4000 feet north
as shown on the Comprehensive Sewer Plan said Agreement being dated August 14, 1974,
WHEREAS, the Engineer has certified his acceptance of the work and his approval of
the final Request for Payment,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the original contract amount was $243,411.95 and that the final contract
amount is revised to $244,909.72.
2. That the work performed by the contractors for Project No:•401 and certified to this
Council by the Engineer as acceptable be and thesame hereby is accepted as of
November 17, 1975. The Contractor is hereby released from the contract except
as to the conditions of the Performance Bond, any and all legal rights of the
Owner, required guarantees, and Correction of Faulty Work after Final Payment.
3. Request for Payment No. 4 and Final in the amount of $31,582.79 to Rauenhorst
Corporation for Project No. 401, Northeast Sanitary Sewer is hereby approved and
the City Treasurer is hereby authorized and directed to pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded
by Cogncilman Seibold , and upon vote being taken thereon, the
following voted in favor thereof: Atting Mayor Hunt, Councilmen Neils,
Seibold and Spaeth
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
