Pursuant to due call and notice theraof, a regular meeting of
the City Council of the City of Plymouth, Minnesota, was held on the
_l7th day of November , 1975 . The following members were
present: Acting Mayor Hunt, Councilmen Neils, Seibold and Spaeth

Councilman Spaeth introduced the following Resolution and

RESOLUTION NO. 75-643
SUPPLEMENTAL AGREEMENT
MINNESOTA HIGHWAY DEPARTMENT
WHEREAS, the City of Plymouth and the Minnesota Highway Department have entered
into Cooperative Agreement No. 15539 relative to Minnesota Highway Department
Project No. 2723-50 on T.H. 55 at the junction of South Shore Drive and County
Road 73, and
WHEREAS, the Agreement states that the City is responsible for 100% of the cost
for the installation of the 42" sewer across County -Road 73, and
WHEREAS, in the installation of said 42" sewer it was necessary to dewater the
excavation area, and in this process the effluent was found.to contain gasoline,
WHEREAS, because of these unforseen conditions the contractor encountered considerable
delay and extra work and has submitted a claim in the amount of $6,166.92 for the
additional expenses incurred,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the Mayor and City Manager are authorized to executed Supplement No.
to Agreement No. 15539 for Minnesota Highway Department Project No. 2723-50, and
BE IT FURTHER RESOLVED that the City Engineer and City Attorney are directed to
contact the owner of the Deep Rock Station at the corner of T.H. 55 and County
Road 73 for reimbursement for the aforementioned amount.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilman Neils , and upon vote being taken thereon the
following voted in favor thereof: Acting Mayor Hunt, Councilmen Neils,
Seibold and Spaeth

Whereupon the Resolution was declared duly passed and adopted.
