RESOLUTION 2009-173
EXTENDING FINAL PLAT AND AUTHORIZING
THE MAYOR AND CITY MANAGER TO EXECUTE
AMENDMENT NO. 2 TO THE DEVELOPMENT CONTRACT
FOR TARYN HILLS 3"" ADDITION (2006057-F)
WHEREAS, Lennar d/b/a U.S. Home Corporation has requested an extension of the final plat
approval and Amendment No. 2 to the development contract for "Taryn Hills -1 Addition" for
property located northeast of 61" Avenue and Lanewood Lane, presently legally described as
follows:
The North 353.87 feet of that part of the West half of the Northeast Quarter of
Section 4, Township 118 North, Range 22 West of the Fifth Principal Meridian,
lying North of the centerline of County Road 47, except the West 675.10 feet
thereof, Hennepin County, Minnesota.
WHEREAS, the City Council approved the final plat and development contract for Taryn Hills 3'a
Addition on September 12, 2006; and
WHEREAS, the development contract was recorded with the County Recorder on June 25, 2007
and with the Registrar of Titles on June 26, 2007; and
WHEREAS, the City Council approved Amendment No. I to the development contract for Taryn
Hills -1 Addition on March 11, 2008; and
WHEREAS, the extension keeps the final plat approval valid until September 12, 2011.
WHEREAS, Amendment No. 2 would change Sections 2, 10, and 29 of the development contract
in order to extend the deadline for completion of public improvements and update the contract.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does extend the final plat approval
and authorize the Mayor and City Manager to execute Amendment No. 2 to the development
contract for Taryn Hills -1 Addition.
