CITY OF PLYMOUTH
Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota, was held on t e 20th day of
October 1975 . The following members were present:

Councilman Hunt introduced the following Resolution and moved

RESOLUTION NO. 75-604
CONDEMNATION STORM SEWER EASEMENT
PROJECT NO. 514 GREENTREE WEST ADDITION
WHEREAS, a resolution of the City Council adopted the 5th day of May, 1975 fixed a
date for a Council hearing on the proposed improvement of storm drainage facility
for the Greentree West Addition,
WHEREAS, under this improvement Project No. 514, it was required to construct a storm
sewer drainage ditch along the following described easement:
Description of Parcel
That part o Government Lot 1, Section 30, Township 118, Range 22, described as follows:
Commencing at the Northwest corner of said Government Lot 1; thence East along the North
line of said Government Lot 1 a distance of 80 rods; thence South a distance of 78 rods;
thei._e West to the shore of Lake Mooney; thence along the shore of said lake to the West
line of said Government Lot 1; thence North along the West line of said Government Lot
to the point of beginning and there terminating.
Description of Easement
A 64 foot wide permanent easement for surface drainage purposes over, under across and
through part of the aforedescribed parcel of land, the center line of said easement being
as follows, to -wit: Commencing at the Northwest corner of the aforedescribed parcel; thence
East along the North line of said parcel for a distance of 664.05 feet to the actual point
of beginning of the center line to be described; thence deflecting to the right 91035' for
a distance of 22.0 feet; hence deflecting to the left 400 00' for a distance of 230.0 feet;
thence deflecting left 20 OO:.for a distance of 270.0 feet; thence deflecting to the
right 54000' for a distance of 275.0 feet; thence deflecting to the left 29000' to the
shoreline of Mooney Lake, and there terminating.
WHEREAS, the City of Plymouth has not been able to negotiate with the property owner for
said easement, and the Council finds it to be necessary, proper and expedient in the
interest of the public health, convenience and general welfare of the citizens of the
City of Plymouth, Minnesota for the City to acquire a permanent easement,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the City Attorney is authorized to commence condemnation proceedings for
storm drainage easement for public improvement Project No. 514 for the.following
described parcel:

The motion for the adoption of the foregoing Resolution was duly seconded by
Councilman Neils and upon vote being taken thereon, the

Seibold and Spaeth
