Minneseta� was a on a 9th day, ofzv October:; x,:197,_5 Thertfollor�in9 mnnbers were present: _ . o owing members, re.a fi=iijjjjjnj%JhWd in I + a; Councilman Hunt introduced the following Resolution and awed a opt on:: is x M RESOLUTION Np. 75-578 ADOPTIN6-ASSESSIENT PROJECT NO.. 413 01, .'STAR BUSINESS- CENTER!sECOND ADDITION WHEREAS, pursuant to proper notice; duly given as required by. law, the Council has met and heard and passed upon all objections to the proposed assessment of 28th Avenue in the Circle Star 'Business Center Second Addition (east of -Niagara Lane and north of 27th Avenue -by the construction of";sanitary sewer, water main; storm sewer. and street paving, WHEREAS. the developer has submitted a waiver of .assessment hearing for -this p ect. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE -CITY OF PLYMOUTH, MINNESOTA: , 1. Such proposed assessment, a copy of wItIch. is -'attached hereto. an,, mach a 'part } hereof, is hereby accepted and shall constitute .thr_spectil assessment against the lands named therein, and each tract of hand therein included`1s herRby foW1d to be benefited by the proposed improvement in the amount of •the assessment 7eyied against it. 2. Such assessmentshall be payable in equal annual installmentssextending Avera period of 10 years, the first of the installments to tie-payatile on'cn bene the first Monday, in January, 1976 and shalI:bear iiteroVat the rate of $X per annum from the date of the"adoption of this.'Utessment resolution., To .the first` installment shall be added interest on the entire assessment frosty`the date of this resolution until December 1975. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Finance Director pay the whole of the assessment on:such property with interest accrued to the date of payment, to the City. Finance Director except that no interest sali be charged if the entire asselsment is paid' within:' 30 days fromtheadoption of this resolution, and he may at any time thereafter, pay to the County Finance Director the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of 'the year in which such payment'i_s made. ? 4. The Clerk shall forthwith transmit a certified duplicate of this -assessment to ,the County Finance Director to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes.
