1. Action Requested:
Review and provide staff direction on potential changes to access related to drive-in/drive through
businesses.
2. Background:
In March 1995, Council amended the zoning ordinance regulations for drive through businesses,
adding a requirement that “these facilities shall be located only on sites having direct access to a
minor arterial street, collector or service road (Section 10, subdivision B, 51). The primary concern at
that time was the potential incompatibility of drive through businesses with residential
development. There was also a desire that these businesses not adversely affect existing traffic
conditions on area streets and intersections.
Staff reviewed the current regulations and found that the requirement for direct access is unclear.
On November 12, 2019, Council adopted an interim ordinance temporarily prohibiting drive-in/drive
through restaurants in order to allow staff to complete a study of this matter.
Subsequently, staff researched and documented access at the 19 drive-in/drive through restaurants
in the city. Details are summarized in the attachments. A map of their locations and aerial
photographs of each are also included in the attachments. Roughly half have full direct in/out access
to either a collector or a service road. An additional five are located in a commercial center that has
direct in/out access to either a minor arterial or a collector. Three that have direct access to a local
street pre-dated the current requirement*. The Starbuck’s in the southeast corner of Highway 55
and Vicksburg Lane has right-in access only, which was consistent with the recommendations of the
traffic study prepared for the development application.
For Discussion:
To address the lack of clarity in the term “direct access” to drive-in/drive through restaurants, staff is
requesting Council to consider two changes in the ordinance language.
The existing ordinance allows restaurants with drive throughs in C-2 (neighborhood commercial),
C-3 (highway commercial) and C-4 (community commercial) districts, with varying conditions for
compliance. Although the ordinance includes a purpose for each of these commercial districts, it
does not define “commercial center.” Staff drafted the following definition for discussion purposes:

Commercial center: An area of commercial activity with shared full access (ingress/egress) directly
to a minor arterial, collector or service road with no internal public roadways. Commercial centers
are intended primarily for use by businesses, such as office complexes, shopping malls, strip malls,
service stations and restaurants. See attached Commercial Center Sketch (example only).
The specific language addressing access is unclear with respect to type of commercial facility and
type of access. To add clarity, staff asks that the council consider revising the current text as follows:
A stand-alone facility shall have full access (ingress/egress) directly to a minor arterial street,
collector or service road. A facility located in a commercial center, as defined herein, shall have
shared full access (ingress/egress) directly to a minor arterial street, collector or service road.
The current language addressing “direct access” also appears in the conditions for drive-in/drive
through restaurants in the C-3 and C-4 districts. Staff finds that striking that condition as it stands is
the only change required as both sections include a condition that drive through service windows
are subject to the performance standards in the section with the suggested revisions above. The C-2
district does not refer to “direct access” and includes the same condition referencing those same
performance standard. Consequently, no amendment is required for this district.
Staff in both the Public Safety Department and Engineering Division have reviewed the proposed
changes and the affect they may have on any new drive-in/through uses in the city. Public Safety
Department data showed that there were too few crashes over a five-year period to calculate any
trending related to access. Engineering staff stated that they favor the changes, based on safety and
traffic concerns.
None of the existing restaurants with drive throughs would be affected by the changes discussed
above, either given their current access or grandfathered status for restaurants that pre-dated the
current requirement. Commercial sites that could be affected by the change include:
Southwest quadrant of County Road 10 and Nathan Lane
Southeast quadrant of Highway 55 and County Road 101 (CVS site)
Northwest quadrant of Highway 55 and County Road 9 (Dundee site)
Northwest quadrant of Highway 55 and Fernbrook Lane (Jake’s site)
Southeast quadrant of Highway 55 and I-494 (multiple sites, including Red Roof Inn and Ramada Inn)
These sites could all develop with commercial uses, but not commercial uses with drive through
facilities.
*In 2002, Wendy's replaced the original restaurant on site. The portion of the associated staff report
that addressed access is included in the attachments.

Conditional Use Permit
The applicant is requesting a conditional use permit to allow construction of a drive-thru
restaurant in the C-3 (Highway Commercial) district. In evaluating the request, staff was
concerned about the potential traffic that could be generated by an additional drive-thru
restaurant in this area. The City ordered a traffic study which was conducted by the City’s traffic
engineering consultant. The study evaluated the impact on affected intersections with the current
traffic controls, and also looked at the effect of planned as well as interim geometric and traffic
control improvements. Interim improvements are discussed below. Improvements identified in
the City’s Capital Improvement Program (CIP) include construction of a median in Fernbrook
Lane to allow a right in, right out only from 28th Place and installation of a traffic signal at 27th
Avenue. After the median improvements are constructed, traffic would not be able to turn left
from 28th Place north onto Fernbrook Lane. Motorists desiring to go north on Fernbrook from
the 28th Place businesses would then be required to travel south on Glacier Lane and east on 27th
Avenue to Fernbrook. The CIP currently shows these improvements occurring in 2005.
However, implementation of the improvements is dependent on securing federal funding. The
City was unable to obtain the federal funds for this project last year. Since the City needs to
secure the funding prior to committing to this project, it is likely that the project will be moved
back to a later year in the CIP.
The traffic study indicated that the proposed use would produce additional noon peak hour traffic,
however it would not produce a significant increase. The intersection of Fernbrook and 28th Place
is currently operating at an acceptable “D” level of service during peak hours. After the Wendy’s
development, the level of service at that intersection would be “E”, however the drop from “D” to
“E” is almost entirely related to a decrease in thelevel of service on 28th Place. The level of service
for vehicles turning left at 28th Place is at “F” during the noon peak hour with or without Wendy’s
(the delay modeled in the traffic simulation increases from two to three minutes with Wendy’s).
The level of service on Fernbrook would remain largely unchanged. With the planned
improvements to Fernbrook Lane, the level of service would increase to “B” during peak times.
The level of service at all of the other affected intersections would be “C” or better.
Since the planned improvements may be several years away, the consultant reviewed potential
interim traffic improvements on Fernbrook Lane that could address the reduced level of service at
28th Place. Staff also reviewed recent accident data at this location. That data indicates a traffic
safety problem at this location. The consultant’s review found that closing the median at 28th Place
to create a right-in/right-out intersection and adding an all-way stop at Fernbrook Lane/27th
Avenue would result in all key intersections operating at an acceptable level of service of “D” or
better (refer to Table 6 in the attached traffic study). Based on the results of the traffic study, the
accident data and the likelihood that a permanent solution is some years away, staff finds that the
City should install the interim improvements now. However, prior to implementing any

improvements, the City would conduct a public information process to inform other property
owners in the area of the pending changes.
