RESOLUTION No. 2009-158
A RESOLUTION TO REQUEST FOR PAYMENT NO. 2 AND FINAL
FOR THE FIRE STATION NO. 1 PARKING LOT RECONSTRUCTION PROJECT
CITY PROJECT NO. 8110
WHEREAS, the City of Plymouth as owner and Hardrives, Inc. as
contractor, have entered into an agreement for the Fire Station No. 1 Parking Lot
Reconstruction Project, City Project No. 8110, said agreement was approved by the
City Council on September 9, 2008; and
WHEREAS, the City Engineer has certified his acceptance of the work and
his approval of the final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $105,507.70 and the value of the work to
date is $102,189.81 and is herewith approved.
2. That the work performed by the contractor for the Fire Station No. 1 Parking Lot
Reconstruction Project and certified to the Council by the City Engineer as
acceptable, being the same, is hereby released from the contract except as to the
conditions of the performance bond, any and all legal rights of the owner, required
guarantees and correction of faulty work after final payment.
3. Request for Payment No. 2 and Final in the amount of $21,106.65 to Hardrives,
Inc. for the Fire Station No. 1 Parking Lot Reconstruction Project is hereby approved
and the City's Administrative Services Director is hereby authorized and directed to
pay the same forthwith. Funding for the total project cost of $117,518.28 will be
from the Facilities Management Fund.
